    Hi everyone, this is my first post so please excuse if I may errors.

    I CCA'd Barclaycard last October to which they have not compiled, Time scale expired mid November so I sent a dispute letter again not acknowledged.

    The same time that I sent the cca request I also sent asking for all information concerning the two accounts (visa & mastercard), this they responded to BUT only supplied exactly six years statements and saying they do not have any other information.

    Going through the statements supplied I noticed that from 2002 to 2005 I had paid roughly £1500.00 in PPI before I complained and got it stopped, didnt really notice it before as due to work commitments my wife settled bills on my behalf, now the accounts were opened in late 90's and I cannot ever agreeing to accept ppi as I was self employed at the time & I am 99.9% sure that the PPI was added automatically when the account was opened as a condition.

    Now, what is the likely hood of reclaiming PPI and interest a) for the period that I have statements for & b) IF I acn force them to supply full statements from the time the account was opened can I recliam the full amount of PPI or am I limited to the 6 year period as are bank charges).

    Thanks for any advice.

    There's something more important here than the PPI payments.

    They have FAILED to comply with your CCA request and as such you are NOT obligated to make any payments to them until they do.

    I must ask, what where you reasons for sending the CCA in the first place ?

      Thanks for the quick reply.

      My reason is that my wiife has lost her job due to company going bust and I asked to lower my payments until we get back on our feet, they refused, hence investigating the chance of reclaiming charges on the two cards.

      As I understand if they cannot supply the agreement they are not allowed to chase me for payment, they are currently added £24 a month in charges and since I complained about them not sending the agreements we have been called 234 times since mid November.

        Sounds about right from this "company".

        As and when they call again simply tell them YOU are recording the call and that you require all communications to be in writing for the avoidance of doubt.
        Then just tell them to remove your number from there database as any further calls will initiate legal action under protection from harassment act.

        They wont like this much, but you are within your rights to say this.
        After all it is YOUR phone.

          One quick question before I go, I ahve heard that they can just take payments from my current account if I stop making payments - is this correct

            Technically while the CCA non-compliance is ongoing then they CANNOT take further action, but it isn't unknown for firms to take the payments form your currant account (with the same banking group) under the Off Set arrangements.

            So if you bank with B'clays, best idea would be to move your accounts ASAP.
