    Thanks CB. It is difficult to remember where all these letters are and which ones to use. Many thanks and I'll get yet another letter off to them straight away.

        Hi,

        Have received another letter dated 9 May and According to their most recent Statement, the account stands, with interest and fees, at £10,256.

        Again, anyone, particularly Curlyben, any comments or advice please?

        Their letter reads as follows:

        Dear Mr Piesky,

        The following options are available to you:

        1. Call and make a payment of your oldest arrears amount totalling £225.36 and see if we can set up a future repayment schedule for you.

        2. Call and we might be able to give you an interest free reduced payment program of approximately £166.82 per month.

        3. Call and discuss the possibility of settling your account with a payment of £3995.67. If accepted, the account would register as a partial settlement; however, we would not take any action to recover this amount.

        4. Wait for a collection Agent to contact you if we do not agree an appropriate payment plan.

        Option 1,2 and 3 are only available to you until Tuesday 19 May 2009. After this date a default will register on your account and credit file for Six years.

        Furthermore, your debt will be sold to a collection agency and recovery fees may be payable by you.

        Please contact us on the numbers below.

              No CB, This is all they have come back with.

              I did, however, respond again with a reiterated formal complaint on 16 April.

                    Well there's a few things you can do.

                    1. Fire off yet another compliant letter and demand action
                    2. Report them to TS for being bottoms and ignoring your legit requests
                    3. Wait and see which DCA they pass it too next, after all you have already done everything reasonable.

                        Hi,

                        Have received this today from MBNA:

                        Dear Mr Piesky

                        It is very important that you read this letter carefully.

                        MBNA has scheduled your account to be written off as a bad debt. Please be aware this does not mean it will disappear. After your debt of £............is written off, we will pursue one of the following actions to recover the total debt:

                        MBNA will place your account with a third party - to obtain payment of the full balance.

                        MBNA will sell your debt to a third party - you will no longer be an MBNA customer and the third party may apply their own fees to the debt.

                        MBNA will refer your account to a solicitor - where we may recover payment from you via a charging order, attachment of earnings or warrant of execution.

                        It's not too late.

                        We want to keep you as a customer and would still like to help, thats why calling us is the most sensible option. We really are willing to help you and avoid a default and recovery action. However, we need you to contact us to ensure we fully understand your situation.

                        What you must do now.

                        Even if you are unable to make any payment, you should still call to ensure you haven't missed an opportunity that will not be available to you after your account has been written off. Call your allotted Account Manager on 01244 674050 now, they will do everything possible to prevent having to pursue recovery action.

                            After all you have been more than reasonable in all if this and they have chosen to ignore you completely.

                                Hi all,

                                I have received a letter from MBNA today saying this debt has now been sold to Direct Legal -Dtl and that all future correspondance and payments should be direct with them at their address.
