    Re: WendyB - v - Capital One

Am filling in my N1, a bit confused as to what I put on the value of claim on the first page. Have got
    charges xxx
    contractual interest xxx
    Court costs xxx
    do i put 8 % as well?
and what about this daily rate thingy?

Also in the POC where it says interest at the contractual rate of22.1 pa presume i put my interest rate, which is only 14.00%

And presume i have to amend my schedule to the date i file the N1 so that the interest goes up to now?

Sorry to ask so many questions - I'm not thick really lol just want to make sure i get it right.

wendy what i did on mine was,at the bottom where it says amount claimed i put the total figure inclusive of everything except court charges.then in the box for it put the court costs. then total it up underneath.
also i did a newer calculation so i have the interest right upto the date of filing
that daily rate thing you dont have to add the amount in the box as until it gets to court that wont be known and its upto the judge to decide on that.

Right, so the bit on the N1 where its says Value, I'm going to put

        Charges £xxxx
        Contractual Interest £xxxxxx
        Sub Total £xxxxx

        plus Court costs £80.00

Then presumably i miss out the bit about the stat 8% cos I've put in CI

Then I add the bit about so much per day....or as the courts see fit....

But in the amount claimed box i put in the total of charges = CI
then add the Court costs in underneath

Boss has gone out for a couple of hours so want to get this sorted so i can get to the Court on Friday

Dont want to confuse matters, but as above, you can reclaim the interest they charged you on the charges also. It should be identified on the list of charges or statements they gave you!?!?

            Re: WendyB - v - Capital One

On the list of transactions etc there is an "interest applied" figure every month, 2 in some months, but not sure how much of this can be counted as being because of the charges, so thought I'd best leave this alone!

              Re: WendyB - v - Capital One

yeh there should be two amounts of interest, interest on your purchases, and interest on your overlimit charges.

Some months there's one, some months there's two, no way of telling which is which so I'm gonna leave it alone. But thanks for telling me anyway

No probs, the reason i mentioned it was because in my own case, it added £120 to my claim

Right, its all sorted now and ready to go. Only thing I'm not sure of is - with regards to the s.69 8%, do I have to enclose a schedule of how I've worked it out? Or will the amount shown in the value bit be enough. Of course i am enclsoing a schedule of the actual charges and CI, but not sure if I need to detail the S.69 as well?

No just the figure is enough, thats all that ever goes onto any claim.

                      Good luck
