    Hi Tafflaff,

    You really need to have a look around the various reclaiming sites and study some of the Egg claims.

    It is true that most sites now seem to advocate claims based on statutory interest only. However Egg like most credit card Companies seem quite willing to pay back all charges plus statutory court interest anyway so all most reclaiming sites are doing is actually guiding Claimers through a process to achieve something that the credit card companies are quite prepared to do anyway.

    The Courts currently have no Statutory powers to award compound interest in cases like ours. Common law with respect to interest awards has always been a real mess. However, the recent House of Lords ruling in the Sempra V Inland Revenue appeal has actually developed law forward a considerable way and put to rest some of the old preconceived ideas wrt interest awards.

    I have my final hearing with my Capital One claim tomorrow and hope that my Judge will be the first County Court Judge to put his head on the block and award compound interest for my restitutionary claim against Cap One. You may wish to wait until tomorrow to make your final decision as to how to proceed in your own claim. Claimers have been paid out compound interest on their claims before now but only as a result of a summary judgment against the defendant or as the result of the Bank or credit card company settling the claim in full at the last minute. As far as I am aware no Claimer has to date has been awarded compound interest as the result of a properly argued and judged claim for either credit card or bank charge refunds.

      May I refer you to your recent correspondence dated 18th August 2008 . I have now reviewed the statements supplied to me by you and have attached a new spreadsheet with the corrected figures. You will note that the figures go back to a little over the six year deadline; this is due to the huge delay in Egg sending out my requested statements.

      I have suspended my MCOL claim temporarily whilst you digest this letter and spreadsheet, however should I not receive a full refund of my penalty charges - £460.00 and Interest of £1279.99. I will recommence court proceedings with no further warning to yourselves.

        I assume you don't want them to eat your letter, but instead presume that you rather they digest its contents?

                    1) If you wish to go ahead with a claim for compound interest I still suggest that you await the jugment in my own Capital One claim which is due any day now.
                    I would then be pleased to help you with a suitable POC. There is little point in continuing to exchange letters with them if this is the way you decide to go. We can handle the additional £60 charges using the standard arguments against the limitation act.

                    2) If you decide to just go for stat ( basically what they have offered ) then we could try another letter referencing arguments against the limitation act and see if we can squeeze the extra £60 out of them. It probably wouldnt be worth the hassle to take them to court for the sake of an extra £60 ( plus a few pounds interest ) though unless you really want to.

                    Will let you know result of my judgment as soon as it happens.

                      Hi,

                      I have finally got through my statements from Egg and am preparing my case as I would like to claim the full ammount of interest taken from me. Have there been any ruling as yet?

                      Also what rate are you charging? I'm thinking of the 24.9% but can we also charge a cash advance fee of £3 per charge if the charge is illegal?

                        Hi , I'm chaRGING 24.9% as well on budgies advice there has been a ruling but waiting for it to be put up on this site (see budgies claim against cap one) cash advance charge is not claimable as far as I know , its like a card machine fee. Maybe one of the mods on here can confirm that for you. Good luck with the claim and keep posting on here, start a thread with the title Nickd v egg.
