  • PKea v BoS Cards

    Just preparining all my documents for the third installment against HBoS.

    This time round its my Credit Card.

    Got all the statements, just need to go through them and sort my spready out.

    Got holiday in a few weeks 'sponsored by barclays' so i will start the ball rolling with this one when i get back

    Well, i think we will get a number of posts like this one, sponsored by the bank. Such a cheek of the banks to sponsor this site

      No don't leave it!!.. if you have the statements, get it going.. by the time you get back from your hols you will be send ing the LBA then...

              I have with CCI too and theyve paid up part but not all, I keep sending cheque back and they keep sending it back to me. Hearing for Directions on 14th Jan 2008. Eeeek. Why are they fighting it the CCI bit. Do they know something I dont.

                as a general rule, it's either CCI OR 8% statutory interest mas:

                of course when they pay out both it's a bonus but if it actually went to a hearing (which i doubt will happen) court may decide CCI or 8%.

                    well that was a long night

                    Anyway sent the prelims off for mine and Kels cards last week and got a response today

                    the usual 'we dont agree with the OFT' but as a goodwill gesture we will give you the difference back'

                    so going to do the spready now and add some interest to the figures and fire off the LBA

                          Well we decide tosend off a CCA request foir them as well and got a 'reconstituted' agreement back.

                          So i have sent off an amended version of one of the letters in CB CCA guide, so we will see what that brings.

                            I have a question for the floor on this:
                            this "reconstituted agreement" being sent out by HBOS, my nephew paid the princely sum of 11 quid (10 for SAR and 1 for copy of cc) to receive this mass produced crap. He hasnt received any SAR information!!!

                            Them not being able/wanting to supply a copy of the signed agreement, is this brinkmanship here by them or is their database so screwed they just havent got it at all?
                            the Boys had an account with them since 2003 on the credit card.

                              Hi Brian,

                              I made a SAR and got a pile of credit card statements. Of course, I can't reclaim any charges beyond 6 years ago, so I can't reclaim anything.

                              The first statement I received is dated Jan 1993 and I have statements up until 2008. But there are missing statements and no agreement.

                              I'm waiting for a court date to challenge them about this and to hopefully reclaim some costs. I was very lenient with the time I gave them to comply with my SAR, and they only did so after I'd filed a N1 at court.
