    Hi guys,

    Recently whist viewing my equifax credit file. i noticed entries from BT dating back to 2008. They just appeared, i HAVE

    NEVER RECEIVED DEFAULT NOTICES for any of the 3 defaults.

    At best all entries are suspect.

    The first one is on my credit file under the incorrect name. Its the right first name but an incorrect surname. and an

    incorrect DOB.

    The 2nd one is the correct name but incorrect DOB, Same for the third.

    Now as explained to BT. The periods in question are very funny times for me as i spent long periods in Canada anything from

    3-6 mths. Work related!!

    so the property was rented to students etc for short periods.

    BT are appearing to not listen to what im saying. please see attached email correspondence.

    Any advice would be greatly appreciated.

    I am hoping you can assist me in this issue I’m having with my Credit file about 4 weeks ago out of nowhere 2 defaults and

    1 query arrived on my credit file from BT I had not been advised of these defaults by post even though you have my home

    address so I was unable to argue them. I was a BT customer at my current address but BT was unable to provide me with the

    BB service I was paying for so they cancelled my contract with no malice.



    Cut a long story short i have spent a long time fixing my credit file as I need to purchase a car for the arrival of our

    child in May. These defaults have caused a major issue in this.

    The information on my credit file is suspect at best.

    I have attached screens of these for your viewing

    · The dates of birth are all incorrect – My date of birth is 19 *** **

    · My name is Mn ( Not mr Thomas)

    · Numbers XXXXXX0** and XXXXXX0** are within a week of each other ?

    I am totally sure that these are incorrect, if however BT feels they are correct I would like them to provide signed

    statements and proof

    I hope this can be sorted as I’ve always had a lot of time for your company and always recommended your services. As I used

    to work on the Openreach Service desk.



    I can’t stress enough how important a speedy resolution is brought to this issue as it is hindering my ability to get car

    finance. And is causing quite a few domestics between me and the wife.

    Thanks for your e-mail to Ian. I'm really sorry for the problems you're having with the BT items on your credit file.

    As some of the information in your original e-mail is crossed out I wonder if you could provide me with some more detail.

    I've been able to find the 1st item for account number ending 07**.

    The second item on your list with the default of £56 doesn’t have any account references, do you have the full account

    number for that?

    I've been unable to find any account numbers relating to you or to the two addresses ending in 0**3 - again could you give

    me the full account number.

    You've asked for correspondence by e-mail and I will continue to do that but if you don’t mind me calling, let me know the

    best number to reach you on and we may be able to move things on more quickly.

    I'll start looking into the first item until I hear from you and will come back to you on Friday with an update.

    This last one is for A/C G*********11. The middle one in the list.

    It's in the name of Mr Thomas - to disassociate this a/c from your file we need some proof of residency e.g Rental

    Agreement, Council Tax documents or Utility Bills for your address at that time.

    I'll give you a chance to check through the bills and call tomorrow morning.

    Thanks for the info. Just a couble of things. The Thomas acc. Is back from 2008. Do u have utility bills back from then? I

    have nothing dating back that far. Especially from an old address. Also the BT Vision Bill i have never had this service. I

    have always had Sky Tv. Not sure whats happened there. Im starting to panic a bit now. Especially conserned regarding the

    info on my accounts the incorrect name DOB etc. 2007 - 2009 i was out of the country a lot. I think the best thing here is

    going to be if i send an official SAR request to BT. As im going to want proof of accounts before i pay for these defaults.

    Im in work untill tuesday now and am unable to answer my phone.

    Let me know what u think about the Subject Access Request.

    With regard to the Thomas account - do you think it might it be possible to get council tax or mortgage/rental agreement

    from that time.

    With regard to a SAR - the request has to be in writing and sent to
    BT Data Protection Manager

    there is a cost of £10.00 so you need to send a cheque with it and include all the account numbers, telephone numbers and

    addresses.
    It can take up to 40 days. Is there anything specific you are looking for in case I can provide that for you in a quicker

    time?

    Thanks again for your previous email. I can contact city council and ask them about an old council tax bill. The previous

    address was a rented property. The property has since been sold on. That was the reason i gave up the tenancy. The property

    was sub let for periods i was in Canada. Thats why im thinking about the SAR request so i can see signed copies of the

    accounts in question. If any of the accounts are mine then i would be more than happy to pay them. However no default

    notices have EVER been received by me. From BT. The defaults just appeared.on my credit file. Dated 2008. Equifax have

    confirmed that they were not on my account untill recently. Please email me back. As cant answer phone whilst in work. I

    can however email from it.

    What im asking Vikki is can the default notices be removed not settled/satisfied. Cause unless removed even paid defaults remain on credit file for 6years. Also can u send me the original default notices. Which as previously stated have never been received. Thanks

    We aren’t allowed to remove adverse data as it will be a breach of data regulations. What we could do is show the settled dates on each account close to when the accounts were ceased, so it looks like it was paid shortly after the cease. That way it will not affect your credit rating as much.
    I'm still waiting to know if we still have the default notices but the bills should suffice. Again I'll come back asap on that.

    Sorry for the delay in coming back.

    I don't have copies of the 'default notices' but I can confirm that the normal follow up actions on each bill were fulfilled - sending reminder letters, making reminder calls and eventually disconnection and then notice of termination of contract.

    We also sent legal letters for each account, which state our possible intention to send them onto a debt collection agency. They were sent out as follows:

    It looks like BT Executive Level Complaints are being as dense as ever. The onus that any adverse data on any record is correct lies on the person or organisation that caused it to be recorded or placed there in the first place. In your case, it would appear they have recorded someone else's data on your credit file which may breach the Data Protection Act 1998. In the first instance, I would advise you to contact the Information Commissioner's Office (ICO). Their website is at www.ico.gov.uk . I would strongly advise you to speak to their Helpline. In my experience, they are very helpful, but the Helpline can get busy at times. The ICO will be able to advise and guide you on any data protection issues. Also, put BT on strict proof that you owe them money and that the details they have placed on your credit file are correct. Firms like BT will try to make you jump through what seems like a never-ending series of hoops with incorrect data they have placed on record, rather than admit they have messed-up and remove the offending data. This is why it is important to speak to the ICO on Tuesday.

      They have sent me the bills for the time periods when they allege i had the accounts. Now i honestly don't think think i had the accounts, however its possible i did maybe have one of them. I'm really not sure.

      My main complaint is that i have never had the default notices that to my understanding are a legal obligation to send. And when i asked her to provide copies she's unable to do this as she cant find them. ''1 maybe - but all 3??''

      Is the onus not on them to prove the accounts belonged to me as opposed to them proving the opposite. I have asked her to provide copies of contracts which she never has she just keeps referring to the original bills as being proof enough. After all i could potentially send her bills for cleaning her house this doesn't prove that i did any cleaning, does it?

        If BT are claiming you held the accounts and owe them money, the onus is wholly on them, not you. The woman's claim that the bills are enough shows just how ignorant she is as to legal matters and the depths to which BT will go in order to get their hands on money, even if they do so unlawfully or illegally.

        As stated above, put BT on strict notice of proof. If they cannot produce copies of any contract between you and them, they are going to find it difficult to justify their position. They will also find it difficult to explain things to the ICO, who can fine them heavily.

              Forgive me i must be thick?if the defaults registered against the Op are for someone with a different name or different birthdate they must be removed and a civil case for compensation pursued ?

                Totally agree with you, Wales. Unfortunately, the OP is dealing with BT Executive Level Complaints who try to fob you off and then stonewall you when you catch them out. Only Talk Talk's Executive Level Complaints are worse. They shout down the phone at you and lie their heads off. They don't like it when you catch them out.

                ICO should be able to help and provide guidance to the OP. As you quite rightly say, there are data protection issues involved.

                  Update.

                  Just had conf. That these accounts habe been removed from my credit file. And permanently deleted from BT's records. And all it took was advising them that they were going to be reported to the ICO. ;-)
