    Just Lord Wilson & Lord Hodge handing down tomorrow then, pity I like Lady Hale & our old friend Lord Sumption. Doesn't give a time, or I can't see one, any ideas?

    Although the Durkin judgment hand down doesn't appear on the Sky SC channel schedule, it's listed as being streamed live on the SC site. So just checked with SC and it's definitely being broadcast by Sky.

    Sorry if I'm asking a stupid question, but if the decision of the 2 questions above goes in Richard's favour - is there a question to be answered of compensation or will Richard then have to bring a separate case for that using this decision in support of it?

    The issues the SC will make a judgment on are as stated:

    1.Whether there was a valid loan agreement between the Appellant and the Second Respondent.

    2.If there was a valid loan agreement, whether the right to rescind was a "like claim" under s. 75(1) of the Consumer Credit Act 1974.

    Of course that doesn't mean to say they won't make a comment or finding on the credit file default which could be potentially helpful.

    No, the issue of recording the payment activity on an account, (enforceable or not) will not be effected. Reporting a default will still not be considered "enforcement" in CCA terms.

    Whole of everything double triple crossed that this is a sensible, common sense result for the consumer and that if Richard does win it's reported properly and not bandied about as 'the next lucrative CMC market' or any such b*llhooks.

    For Richard, I really hope he gets the redress that is owed to him because the knock on effects of DSG Retails action's have been utterly horrendous.
