  • Incorrect Default filed on my credit report

    Hi, JC International filed a default on my credit file in June this year which apparently related to an outstanding debt with Sky dating back to April 2020. I have absolutely no knowledge of any outstanding monies owed to Sky. I have an otherwise good credit file and this is causing me serious problems. I have entered into endless correspondence with them but ultimately they refuse to remove it. I have contacted the Ombudsman but JC are confident they will not get involved as this was apparently a non-regulated credit agreement. Does anybody have any idea of how I can get this removed or can point me in the right direction for further help. Thank you in advance.

    The original creditor in this case was Sky. Send them a (SAR) Subject Access Request under Data Protection/GDPR Acts. Find out what the original debt was firstly. Links to template in sidebar.
    To file the default, there must have been a debt purchase from Sky to JC - an assignment - you need to see that too but it should be supplied with the SAR.
    Sky very well could be an unregulated agreement so would fall outside of Financial Ombudsman frustratingly.
    Ultimately, if you find out via SAR that the debt is incorrect - you can try the Information Commissioner to intervene for wrongful processing of data or as a last resort - legal action for specific performance (remove default) and compensation for credit damage.
