  • Voluntary termination of agreement.

    Hi,
    My daughter has had to bring a voluntary termination of agreement for her BMW 1 series car, purchased from new. in order to get a mortgage. She has paid well in excess of the 50% of the agreement.
    She had contacted BMW finance via e mail citing the CCA Act Sec.99 and they replied within 2 hours acknowledging the email. They subsequently requested the V5C which was posted the same day. She has now received a letter telling her that a) the finance agreement is terminated and b) THE TERMINATION PAYMENT OF £1402.10 is overdue. Together with a two page letter with instructions as to the preparation of the vehicle by their agents BCA Logistics. prior to collection. The letter emphasizes that additional costs will be raised for excess mileage and damages.

    I wonder if you have any input as to the legality of their demands which appear to relate to the collection of the vehicle, although this is certainly not made clear.

    The vehicle is in as new condition apart from a minor dent in the passenger door caused by someone banging a door against it. The dent itself is 8mm long and the paint is undamaged.

    Do you know what exactly the £1402.10 is being claimed for? Is there a break down or justification why they say it's required
