    Taken a look, and it is fine by me - you could also send by email to Shoosmiths if there is a point of contact email on the letters and advise a copy of the email is sent by post.

    There will of course come a point where the cost of employing Shoosmiths will outweigh taking you to court if it has not passed already. The fact that legal fees are not recoverable in the small claims, it will not be commercially viable for GMAC to continue pursuing you using solicitors and I suspect if they went to court even if they employed a junior barrister that would be at least £700-£1,000 or more. Taking into account the previous letters sent by Shoosmiths the overall costs so far may well at least be £1,500 or close to it.

    Let's wait and see what they say - you still have the option to go to the ombudsman and it would be unreasonable for them to to continue court action where the ombudsman is involved.

      Hi Bob, to be honest i thought that tipping point would have come some time ago and common sense would have kicked in...

      I've got the Ombudsman option until the beginning of April i think so have a bit of time to see what they say first.... thanks again for all your help

      I will come back and post updates in case this thread helps anyone else in a similar situation
