  • s77A refund - can it be statute barred ?

Question : if interest was charged wrongly in breach of s77A 6b ( 2006 Act ) can the entitlement to have this taken off a debt balance become statute barred if the debt is sold on and the debt purchaser says " you have to claim this back from the original creditor "

No. If interest was incorrectly added to the account, you are disputing the balance of the account. This is not a separate amount which is owing to you.
