    Had a fab idea though I'm not sure if it could work against me should the case go to court.

    Many DCAs send income and expenditure forms. So has Credit Security Ltd. As far as I'm concerned, the information they request is none of their business.

    I was thinking about sending them a form, asking questions why they believe the alleged M&S Money mastercard account is enforceable. There would be questions about the steps they have taken to ensure that the information provided by their client is accurate. They would be asked to study Santander vs Mayhew case. Then they would be told that the Judge ruled that a store card turned credit card was unenforceable unless a new consumer credit agreement was signed. She also awarded costs to Santander. Now Credit Security would be asked to explain fully why they believe that my alleged account would be different from Mayhew's.

    I could then add some personal questions regarding collectors marital status, religious belief, sexual orientation, race etc.

    What about that?

    Lovely idea. Only weakness.....

    They'd need to know how to do joined up writing, spell and string words together to fill in such a form. :doggieyes:

      I had a bit of fun with a caller from Cabot although I have to admit to having had a couple of glasses of wine prior to the call and not knowing who was calling me until I answered the phone.

      When the rude man asked me to answer security questions to comply with the Data Protection Act I said that I would only comply if he would be so good as to answer the security questions I had for him! He said something rather rude before slamming down the phone. Two years on and I'm still waiting for a follow up call!

          Don't you mean the judge awarded costs against Santander and not to them?

              You know, in light of the OFT action highlighted in ‘Over Ł149 million to be repaid to bank and building society customers following OFT action’ how can it be absolutely tickety boo for lenders not to send a new agreement never mind other information when store cards were upgraded to credit cards? I know Mayhew won in the above mentioned case but by no means is it a sure thing that others will win if taken to court. Santander offloaded their toxic store to credit debts on Arrow but this does not mean that these ******s will not win. It really depends on the Judge. I have emailed David Fisher atthe OFT asking him this question and surprise, surprise he has not bothered to reply.
