Re: Urgent help needed!!! Terminating a HP agreement

You only need to tax a vehicle if it is on a public road, if it is not you must sorn, to prevent you being prosecuted for lack of tax https://www.gov.uk/register-sorn-sta...d-notification

I was referring to charging storage for their vehicle. Hopefully it will not come to this, it never usually does.

So in my case the car needs to be tax. Again I am in the situation where I will have to renew the tax disc as I cannot do a SORN. Which brings me again to the same question. I renew the disc, I will need it back though to get a refund afterwards? or do I have to count my losses and pay £121 for it so I don't get prosecuted?

Andy thank you for your replays! But I am afraid I still fill that I don't know what to do.

a)The tax expires on the 30th April. I f the car is still parked on the road I am commiting an offence as I am still the registered Keeper...V5c still in my name? The 14 days to re-apply for a tax disc only applies if the car is off the road. I know that the car won't be taxed for only 3 or 4 days till the collect it but it is a offence.

b)Then is the question that they say if the car is not taxed when they collect it they will take it as a non runner and will charge me £115 for it.( I know that I can refuse to pay it which I am happy to do) But I am still concerned about the car not being taxed while in my possession?

          c) They say the want the V5 (log book). Why do they want this?

          D) Should I inform the DVLA that I have done a VT therefore the car is no longer mine?

Sorry about all the questions, just trying to get an understanding of all this mess. I cannot find the letter where you refer to section 100? Can you post me a link?

          Many thanks again!!

No really sure how many ways I can give you an opinion on this.

I would not tax the car as after the termination date it will not belong to me, I would let them know this if you have not already. The information regarding transferring ownership of the vehicle in respect of the v5 documentation is available on the DVLA website.

You need to tell them that after the date of termination their car will need to be collected. The letter is on the VT thread, if you have not found it, you need to look harder, I cannot do this for you, you have to do it yourself.

Let me know if there are any developments.

Re: Urgent help needed!!! Terminating a HP agreement

Thanks again for all your advice. I spoked to the DVLA this morning and I wanted to share this with you all.
I have been told to fill in and return section 9 of the logbook. This is to remove myself as the vehicle's registered keeper and put the Finance company's details instead. By doing this I am not liable for the tax any more as from today. But the Finance company is. I should be receiving conformation from the DVLA in 2 to 4 weeks time but they said it is backdated t the day I sent it.
I am going to email the Finance company to inform them that the vehicle in parked on the road, not taxed and it is now their responsibility,
The Finance company asked me for the logbook. I only nned to send section 9 to the DVLA hence they can still have the rest of the logbook.

Re: Urgent help needed!!! Terminating a HP agreement

                  Update on this...
It was not so straight forward after all. Section 9 of the log book has to be signed by both parties, myself and the finance company only when the vehicle in taken away ( I called DVLA back to double check this).
They told me my only to options were to either park it off the road and SORN it or renew tax disk and then remove it on collection day to get a refund as the tax disc belong to me.
I had no other option to do the second option but them the collection company phoned me and I they are able to come tomorrow ( tax expires today). They said it was not a problem as they put new plates on the car to go under their trade tax.
So in that respect it has all worked out for me. Well lets hope it all goes well tomorrow. But some advice for others...when doing a VT, make sure there is still plenty of TAX, MOT and INsurance left in the car only to make life a lot easier for yourselves. Insurance can be then cancelled on day of collection, and the Tax disc can be also removed and claim back.
Will let you know what happens tomorrow!
                  Thanks again!!
