  • Voluntary Termination - Charging for storage of vehicle

I recently exercised my right to voluntary termination for my vehicle. However Mercedes benz's agent cannot collect the vehicle until the first of december. I informed Mercedes Benz of my intention to terminate the agreement on the the 13th of November and informed them that if the car was not collected by the 20th of Novemeber I would charge them for storage at £200 per day.

However the earliest their agent can collect the car is the 1st of Decemeber. Mercedes benz have since responded as described below:
In relation to your comments surrounding the storage charge that you would like to invoice us for, I feel it is important for me to highlight that Mercedes-Benz Financial Services are not contractually obliged to accept any form of counter claim for expenses relating to the vehicle collection and as such we would not look to pay any invoice raised for the cost of storing your vehicle.

What is my legal position regarding this? I suspect I would be responsible for storing the car safely and ensuring no damage to the vehicle is incurred until it can be collected. How would I go about enforcing payment for storage?

I have attached a copy of the email and document I used to terminate my agreement and also their response with regard to the charges.
