  • Welcome Finance - Statement Errors

Would really appreciate any help or advice.

Long Story but i will keep it snappy.

In 2008 we took out a consolidation loan with Welcome Finance. PPI was added to the Loan to the tune of £3500. To cover the cost of PPI our monthly repayments were around £50 higher than we had previously agreed. As we cancelled after the cooling off period (although we never knew we had it in the first place) Welcome refunded £1500. On requesting the paperwork the PPI had been falsely signed for by one of the staff at the brokers (Bluesky Finance). We disputed this and ended up with the FoS who after 2 years agreed that we had been falsely sold this PPI and ruled that Bluesky refund the monies with interest and that the account be put back to a position as if we had never had it. We received the monies with interest which we sent straight to Welcome to knock off the balance.

In the couple of years we were in dispute we were often unable to afford the £355 a month instead of the £305 that we had previously tightly budgeted for. We had dozens of letters over that time, charges and defaults etc often 20+ telephone calls a day chasing the extra £50 a month that we couldn't afford at the time.

After the ruling by the Ombudsman Welcome refused to put the account back to a position where it should have been. In the last couple of years the Statements, arrears notices, defaults etc have all shown different balances. The fact is they keep getting the balances wrong for some reason. Some statements say that on such and such a date our account balance was £12000 and others over £18000. The figures are always wildly out. I have written on several occasions and they simply write back and say that they did not receive the proof that i stapled to the letters of the wrong balances. I have phoned them but they just fluff over it. In January i sent in a SAR and soon received this interesting manuscript back of my telephone conversations etc. They acknowledge an IT problem in there but little else. I wrote a letter to their Chief Exec and the account was reviewed by a senior manager who again said she could find no evidence that they had sent out statements with differing amounts, she sent an up to date statement which is i think was correct.

I opened a complaint with the Ombudsman against all the charges i have received, the inaccurate statements, balances, letters etc they have sent me. i also asked for a default to be removed as it would not have been there if the account was returned to a position of never having PPI (all copies sent) and on Friday they contacted me to ask what it was i wanted / complaining about (despite providing a detailed letter and 107 pages of letters, statements and evidence).

On Saturday i received my Annual Statement from Welcome. It is around £4000 over the balance that i am at and states in previous statements with no evidence as to why.

In my complaint to FoS i asked that because all the statements, letters etc have had wrong figures on and that i have been unable to work out what is owed etc that the charges should all be refunded, and that the account (as they ruled in the PPI complaint) should be returned to a position as if i never had PPI. I also asked, and this is where this post comes in that ; I have to date payed £20000 in monthly payments on a loan that was initially £15000, i have around £10000 balance to pay although they say over £14000 on the latest statement. I have asked in my FoS complaint whether the interest is legal as they have gone against the CCA in not been able to provide me with an accurate balance or statement even to this date.

So, I am phoning them tomorrow and want to know whether to push the legality of the interest or have i not got a hope in hells chance. Should i consider legal action over this whole mess and should i re-contact Welcome to ask what on earth is going on AGAIN with these wrong statements ??

Any advice would be appreciated, Thank You !
