I thought you said this was SOLD to Connaught when you defaulted years ago! If it was assigned in absolute, Connaught/1st Crud now own this debt, not Barclays.
The right to set off only applies to your own money, not the overdraft facility. They can't take money you haven't got.
You can try, but if they can't supply a CCA you can also just stop paying and sit it out. That's what I'm doing... :thumb: Why pay 10% (provided they accept it), when you can pay 0%, if there's no CCA they can't get a CCJ.
See above, they can't offset from an overdraft, just from your own money. Also if the debt has been sold, Barcraps can't take money to pay Connaught!
We are getting things mixed up here with the issue of set off. If you are making token payments it's because you've already defaulted, and that was years ago. If you had money within the same bank, they could have offset from that account when you defaulted, and they would have done so regardless of whether you made token payments or not, as you had broken your contractual payments, they would have the right to offset.
Now this debt is owned by Connaught/1st Crud not Barcraps, it got defaulted years ago, no reason they should offset now.
