      Hi gravytrain, have had a chance to see if your last post was valid. I am still paying for the car, but would like to know if I can voluntary return it or other options. Please help....

        If your agreement number starts with a '698' it is a Bill of Sale (you should have a copy of the agreement stamped by the court), and it cannot be terminated by you at any point before the end of the agreement, other than having the car repossessed with full liability. If your agreement number starts with a '274' it is a Hire Purchase agreement and as such, you have halves and thirds rights, i.e. when you have paid half you can Voluntarily terminate the contract with no further liability, if you have paid a third but not half, The Funding Corporation cannot repossess the asset without firstly obtaining a Return of Goods Order via the court. If it starts with a '358' it is a personal loan, and you can sell the asset yourself. Additionally, you can Voluntarily Surrender a '358' agreement to reduce your indebtedness but you will still owe the remaining balance.
        Also, if you have accrued 'fee's' for late payments etc, these are written off at the end of the agreement anyway!

          Stopping payments would be the worse thing to do, it would effect the OP's credit rating preventing them from getting future credit, and would escalate the problem even further. By maintaing payments it will give the OP good standing in the eyes of the court should this go to court!
