    Hi

    I sent a cca request to old bank accounts only for them to send the £1 fee back stating they are not obliged to give this information.

    Is this right are they allowed to do this, both loans are completed paid up in full for some time now
    Is their anyother way of getting the actual cca from them? I have already sar'd but this did not supply it

    Any help appreciated

    Bank accounts overdrafts have part V exemption under s74(3). In other words, it is not required for them to have a CCA in any form that you can request under s77/8 etc.

      Nibbler is right regarding overdrafts, however i notice you mention "bank loans".

      If this refers to a loan not attached to a current account(overdraft) then they would need to have made an agreement under the CCA.

      However if the loan is paid up, they still would not have not supply a copy under a section 77-79 request(only applicable when their remains a sum outstanding under the agreement).

      Your best bet would be to make a request under the data protection act, it will cost you £10 and they should respond within 40 days with any paperwork relating to any account you have had with them .

        They say they have already SAR'd the bank, and no CCA was produced.

          Sorry i missed that bit, I think it needs clarifying, what kind of loan this refers to. They should keep any paperwork for 6 years under money laundering regs

            Indeed. On the OP's other thread they were reclaiming PPI, so maybe they want the CCA for that? But yes, need clarification on what type of regulated debt this is, and what they need the CCA for.

              Thanks for replies the cca's were for loans attached to a current account. I have already sar'd but this did not reveal the cca's only gave loan numbers and how much ppi was added and repayments made. The accounts are from 1997 & 2000. Wondered if i could request further info from their data protection team but guessing this will not produce anything either.
              Is their anything else that can be done or is it the end of road in gaining the required info

                Im after this info so that if ppi reclaim goes to fos then I have all the info needed as to date banks have refused ppi claim.

                  As noted on posts 2 & 3 above, you wouldn't have signed a credit agreement for a loan attached to a bank account, so you wouldn't be able to obtain a CCA because there was no requirement for one.
