DSAR returned by HBOS ?

  • DSAR returned by HBOS ?

    Got a response from HBOS to my 45 day old DSAR today.

    It's headed 'Informal DSAR'

    "For all DSAR's we provide this, in a simplified format, free of charge, we will return your cheque in 10 days."

    "We believe this letter contains all the info you require...however if this is not sufficient please re-apply with a cheque for £10."

    It then has a sheet with the 'data' on it...which is my credit card number...that's all !!

    Wtf is this all about....a stalling operation , they are trying to fob me off...??

    You wrote informal DSAR(I assume you mean Subject Access Request) and they provided you with the account number. A more complete one costs £10 which will include all data.

        Did you send a proper SAR letter asking for all data they hold about you, using a template either from here or the other forum, with the £10 fee?

          yes I did, the full bag of mashings, and a cheque for £10 for all the data held about me, and that was their reply !

            now it might mean they are trying to fob me off 'cos they don't have the crucial info ?

              erm, yeah...I did all that..sent the cheque...asked for all the data....using the templates...pah !

                Resubmit it with the cheque and complain to the ICO, as the bank is playing at Silly Buggers.

                  I misread your first post which clearly stated that they posted the heading "informal DSAR". Do you have a copy of the letter that you sent? Did they cash the £10 cheque/postal order?

                    45 days to tell me what my card number was...!

                    It's shocking isn't it....Is it the ICO who govern the DSAR's ? Is the Bank legally obliged to reply to such requests...properly that is, or will they feel this extra 'step' on their process is an acceptable additional process ? They had written to me a few days after my initial request asking for any additional addresses I've had since I took out the card, they said they needed this before they could process my request. So in fact they've stalled me twice.

                    As I said earlier, it may be a positive sign that they are stalling deliberately as they do not hold all the required info, like maybe a copy of the agreement etc which dates back to 2002? Does their failure to respond to a DSAR make the account unenforceable in any way, while they are failing to reply ?

                    Is there a template to cover a re-submission of a DSAR for their failure to respond, or should I just cobble up something myself ?

                      One would certainly hope not, or any data processor would get away with merely replying that they know their customer by "customer's name" - which makes utter nonsense of the law.

                      As I remarked earlier, they are playing at Silly Buggers and apparently for no better reason than that they suppose they might be allowed to get away with it.

                      No, as you'd need to have made a s77/s78 request under the Consumer Credit Act 1974 and submitted the £1 fee for their failure to supply the "reconstituted" agreement (as per wacky Waksman QC) to render the agreement unenforceable.

                      Mad, isn't it?

                      I'd doubt that there is a template, as this is a novel variant of Silly Buggers not hitherto encountered.

                          I have not seen the cheque cleared in my bank, and the above statement says they will be returning it, in 10 days, although why they found it impossible to pop my cheque in with their letter seems barmy. Just another delaying tactic, as obviously I'm not going to send another cheque while they have this one floating around..

                          By the time this is all done with, from my 1st letter to them on 21st January, we'll be well into May.. assuming they do in fact respond !!

                            If the account was with formally Halifax then email the Managing Director David Nicholson
                            If you can scan their letter and include it as an attachment then do so plus a copy of the original request. Tell them that you want it treated as a formal complaint that you have asked for a Subject Access Request and that they have delayed unnecessarily the production of it. Tell him that he has until April 2nd(roughly two weeks from tomorrow) for that request to be completed satisfactorily otherwise an ICO complaint will be made. That should hopefully help things move forward a bit since you have the credit card number.
