    Here is the letter. Doesn't make much sense to me.


    DEBT OWED TO ARROW GLOBAL LTD
    ASSIGNED BY NCO EUROPE LTD (ABBEY NATIONAL ACCT NO********)

    We thank you for your letter dated 3 2 13 addresed to NCO Europe ltd and passed for our attention as assignees of the debt. We aknowledge your request for documentation pursuant to the Consumer Credit Act 1974.

    We do not accept that we are the creditor as envisaged by the above statute. However we are willing to assist obtaining that which has been requested. We will now process your request for documentation from the originating creditor and will revert in due course.


    We also note that you have requested a copy of the Deed of assignment. Please note that we have been assigned this debt pursuant to the law of Property Act 1925. You are not a party to the agreement we have with NCO and are not entitled to to a copy of the Deed of Assignment. If you believe you have a right to see this please cite your authority.

    The account is currently being operated on our behalf by NCO Europe ltd We will deal with this document request only and all other enquiries should be direct to them.


    Can anyone tell me what I should do now as a respone to this?

    Arrow Global are debt purchasers, presumably they bought your defaulted Abbey account. What was it? A credit card or loan? or an overdraft? Because different rules apply to O/Ds. If Arrow purchased the account and are chasing you for money, then they are the creditor, however, they would still have to go back to the OC (presumably Santander who bought Abbey?) to get the documentation, debts are sold in bulk without any paperwork.

    You wouldn't normally get a copy of the deed of assignment because it's a document between two commercial entities that doesn't relate to you, what you'd get is a Notice of Assignment (NoA) which is necessary to establish who owns the account.

    As they are saying they will process your request for documents and revert back in due course, there is no action required on your part until they do.

    Would be useful to have a bit more info on this, such as what type of account it was and when it was opened, in particular, whether it was before or after April 2007. If you applied online for this account, it could also make a difference whether you applied before or after Jan 2005.

      Hi Flaming Parrot, thanks for such a quick response. It was a joint bank acct pre 2000, overdraft. It was applied for in branch. The total is £4845.

        Also they certainly are the creditors under the CCA, if they have bought the account under the LOPA, refer the to Jones vs link financial [2012] EWHC 2402 (QB) .

        As FP said you should have received a notice under the act when the assignment(sale) of the debt was made.

          Unfortunately if this was an overdraft you will not get an agreement under a section 78 request, there was no requirement to have made one in 2000 under the act.

            I suspected it may have been an O/D and I thought I'd posted something about it but I can't see it... A CCA request wouldn't apply here but Arrow probably have no idea where the debt came from in the first place, which is why they didn't just say so. The dates and type of application would have been relevant if this had been a card or a loan but sadly not an O/D.

            If you want to find out about charges you could send a SAR to get statements, but it would have to go to the OC (presumably Santander who bought the Abbey), not the debt purchaser, as they wouldn't have the data in their possession. A SAR costs £10 and they have 40 days to respond.
