  • Problem with Credit Agreement

    Hi All

    New to this forum and hope some can help?

    I desiede to revisit an old PPI claim that failed the first time around. I sent a SAR's letter to the loan company GE Money Consumer Lending Limited. On receiving the reply to my SAR's request the first thing I noticed is that the loan is with a company called First National Consumer Finance Limited. The laon was executed on the 13/04/2005. So I desided to check out the agreement.

    First port of call was the public register to check the Consumer Credit License. Very interesting First National Consumer Finance Limited surrendered there License in January 2005 so we have UNLICENSED TRADING and GE Money Consumer Lending Limited was added.

    Then on the 3rd October 2005 First Nation Consumer Finance Limited changed is name at Companies House to GE Money Consumer Lending Limited.

    In my SAR's request I had included requests for copies of the Notice of Validation (required to make the agreement enforcable at Law) NOT supplied, a request for any Notices of Assignment or dates the debt was sold ( Neither supplied).

    So the question I have is which company has to apply for the Validation Request?. and does the debt have to be transfered in some way to GE Money?.

      Can a Private Limited Company start trading before registers with Companies House
