    Many thanks for the defence. Just to clarify as I am a bit dumb about these things.

    I need to send a hard copy to the Court including all copies of documents I refer to (Attachments) ?

    I need to print of a N244 form from the Court website and complete as per your attached N244?

    I need to print off all the relevant parts of the Consumer Credit Acts that I refer to in my defence (ATtachments)

    Where do I find these documents?

    Sorry for sounding so dumb on this but this is new to me.

      I had the attachments saved from other defences so have put them together for you and have updated your defence with the relevant attachment numbers

      You will need 3 copies in all, 1 for you, 1 for court and 1 for claimant



      EDIT

      I went back in and tidied up the Attachments list, good to go now but please wait for Teaboy to give it the once over just to make sure that I havn't missed anything or got anything wrong

            I think the fee can vary but i am unsure as to why

            As Mike says he had £80 to pay but I know that Shep had only £45 to pay but he only submitted a N244 and a unless order, so yes phone the court to check, and make sure you tell them you will be submitting a N244 application for a unless order and an amended defence to ensure they quote the correct fee

            Defo send everything minimum recorded delivery so you can get proof of postage and delivery

                On the N244 can you check the following

                , The claimants POC to be struck out, because The Claimant submitted this claim on xx/xx/xxx, The defendant submitted a defence on xx/xx/xxx, as per court procedures the claimant has xxdays to respond to the court regarding the defendants defence, to date the claimant has not responded to the court, thus being an abuse of process and wasting courts valuable time

                How many days have they ?

                Also can you check the N244 form on the court website as different numbers to what you have on Barton ammended 244? Just want to check Also where do i put to be moved to Durham CC ?

                      3. = Part A Put in all of it including getting the case moved
                      4. tick Yes
                      5. Without a hearing
                      6. leave balnk
                      7. leave blank
                      8. leave blank unless you know what level of judge has dealt with the case so far
                      9. Court (i think) and poss the claimant (as I suspect they will need a copy sent to them to
                      10. tick 1st, 2nd and 3rd
                      in the big box add what is on part c

                      Maybe teaboy or others could also comment if I have this right or not

                      With me being from up here in Scotland I have never had to fill one of these in (I only word them) so I am not 100% sure I have the right things in the right boxes, so please wait for others to comment or correct me please

                        Evening all,

                        I am a bit of an interloper here (Dougal v HSBC refers), but DG are one of the biggest shower of shish kebabs (putting it politely!) I have ever known.

                        Completely incompetent and blissfully unaware of what Litigation is all about.

                        I am being interviewed regarding HSBC tomorrow, and will certainly be mentioning DG's appalling behaviour, and asking why they are allowed to get away with it!!, and why HSBC let them!

                        Keep up the good work, but watch HSBC because they will breach Orders of the Court, and you will need to notify the Court of ALL breaches, as I did.

                            In my (humble) opinion it is easier and more productive to try knitting fog! SRA are basically a toothless tiger, just a re-vamped Law Society....need I say more?

                              Strange you should say that;-

                              Law Society did not want to know when I mentioned a complaint about D.G. Solicitors part of HSBC, as I was not making a complaint about my own (if any Solicitor) but a third party one.

                              The telephone call to Law Society was within the last few weeks, so not an old occurance.
