  • Advice needed re. Section 75

    I really need some help regarding a problem that I am having with regards to a loan. Years ago I signed a credit agreement for tuition for someone else. At the time I was told that the loan was in the other person's name and I was signing to be the guarantor. This was not the case and the loan was only ever in my name (I am already aware that I should have read the credit agreement properly so please don't feel obliged to point this out). As soon as I discovered this I complained to the tuition company and requested that they cancel the credit agreement as it had been sold through deception. While they admitted that they had implied that the other person would be asked to pay, they would not cancel the agreement. The dispute continued and the company went into administration so I was never able to complete the process. They are now saying that Section 75 doesn't apply to my case because the tuition was for another person. No one has ever undertaken the tuition, nor been offered alternate tuition. Is it really the case that I have no rights under the consumer credit act as the loan was for tuition for someone else?
