  • Newbie - Advice & Guidance Please

    I have an existing card with Virgin/MBNA, i cannot recall the date this was taken out (balance Transfer) but i think around 2003/2004.

    I have seen so much in the media regarding the enforceability of the CCA and would like some basic advice as to what i would need to do in order to ascertain if the account i have is enforceable against me. I have never missed a payment (balance around £4000) but i am in severe financial difficulty at the moment.

    Thanks for taking the time to read looking forward to any advice/opinions you guys may have.

      Im not sure you will get much response on these forums if you are trying to avoid debt. You admit the debt is yours, but I read that you would like to try to question the validity of the debt as you are in a difficult financial situation. Eg, it would be nice if you could walk away without paying another penny. That tends to be frowned upon and is not really what forums like this are about.

      What may be a better solution is to enter into a payment plan with the creditor. If you cannot afford the monthly repayments, then offer them an amount per month that you can afford. This can help get your monthly outgoings down across the board and help you back into a better financial situation.
