please can you help me my friends dad has died and barclays are chasing him for 500 pound that his dad owed, they have also sent a letter asking him to sign and they will sort it all out. i have told him to sign nothing....its also distressing his mother badly can they do this...also before you ask he left no money and lived in a council house many thanks

Did all of his assets pass outright to the widow ie was everything jointly owned?
Is the estate solvent after the payment of his funeral costs and any legal costs?
Credit card debts are legitimate debts that are required to be paid from his estate, after the funeral and legal costs. That is, assuming there is sufficient liquidity in the estate to do so.
So depends on the circumstances.

thank you so much for the reply, this is a really strange one the day before he had his heart attack he took what money he had out and no one knows where it has gone and the police wont say how much was taken out . he is divorced and two sons who dont speak .he left an old car that was sent to scrap yard by the council off the drive....there is no money no home ,my friend has taken charge of thing because his mother has gone to pieces. he has nothing to give he has left small debts after living a simple life on pension in a council rented flat...and my friend has nothing to give he is a single man with 4 kids in my rented house. i am concerned they may send baillifs round to his house trying to bully him at a time he doesnt need it.not only just after his fathers death but he has all 4 kids under child protection due to serious matters in his life from a nutcase ex... can this be stopped without doorstep confrontation. he has done a fantastic job with those kids they dont need to see this either manythanks always a great help to me keep up the good work

If the estate is insolvent then there is nothing to pay the creditors. Period.
They should be written to, with official copies of the death certificate and scheduling the financial details of the deceased, explaining that the estate is insolvent and that there is nothing for them to recover.

Providing they are given a death certificate(copy) and that the estate has no money then the debt dies when he does. Providing there is no secondary cardholder they have no right to send bailiffs in, they have no right to expect payment and they have to write off the debt."Family means that no one gets forgotten or left behind"

this site is fantastic if more people knew just a little bit more of what to say instead of been bullied by letters and men in suits or dodgy phone calls,if any of you get a minute go and watch EVERYTHING IS OK [BANNED]a policeman on a cycle on youtube and watch how a a man in the know ties a policeman in knotsits good and very funny just goes to show that people in higher positions lie to get what they want and we just take it as gospel ,thanks for your replys yes it is only 500 they are chasing and i think i may send some bones in a jar and ask them to get there money from that. i have a funny feeling that may make the papers.heartless gits also i will go and get the letter and post it for you to read shortly. once again manythanks from you all

If you want to send them "mortal remains", send them bonemeal rather than bones. Even someone lacking formal qualifications can usually tell the difference between animal and human bones, whereas one kilo of bonemeal looks much like another.
The only difference between my late aunt's ashes and those of my late father is the father's ashes are a bit finer - but then, I did ask for a finer grind so I could put him in an hour-glass. msl:

When my mother died she had roughly about £1k owing on Barclay Card, as soon as I sent them the death certificate they wipped off the debt 100% and we never heard from them again.
Send the death certificate by special delivery if you have not already done so, so then there can be no argument about them having received it.
If you receive anymore threatening letters please post them up omitting any personal details so that we can help you respond to them.

i will be speaking to my mate shortly i will advise him and i hope barclays listen.his mum has taken his death badly why would a bank upset someone over 500 pound there should be a law against it .i still have my close family i would be kicking off big style if i were him,,,,,its a disgrace of the highest order
