Re: Defence required for defending CCJ taken out by MBNA Europe prior to enforcement.

Hi - Im in the process of fighting MBNA and Restons in court and I am undertaking a counter attack and seeking damanges. Thinking through this, I thinking to broaden my approach and maybe turn this into a class action suit. If you have had dealings with them, and you are interested, send me an email with a link to your posted experiences or a brief overview of what happened/ishappening. If I can this ball rolling, I will post further details and I will in any case respond to your email.

    Cheers,
    Erik

Hi Erik, will email you later with ongoing experience.

Class action sounds good idea, but may be costly.

Re: Defence required for defending CCJ taken out by MBNA Europe prior to enforcement.

Restons, on MBNA's behalf, are quite ruthless in pursuing people.
My outcome was a CCJ against me followed by a charging order on my property.
This allows them to recoup the alleged debt once the property is sold.

Moral is to get a defence against CCJ ASAP. This happens very quickly and unless you have a case against them at the beginning, events can overtake you.
The courts aren't very helpful, so unless you can afford legal representation, they will apply the law & leave you floundering. Compassionate they are not.
There are various grounds to counter, depending on the exact circumstances of your case. You need to have strong arguments and able to prove what you assert.
You also need to have all information to fight your case relatively quickly because Restons don't hold back once they start.

Good Luck & feel free to communicate if necessary.
