    I have been trying to get a copy of my agreement from Barlclaycard for 18 weeks now, I have now had letter from Mercers, has anybody on here ever received a copy of their signed agreement. The woman at Mercers said that they would not take the matter to court. I wish they would, at least then they would have to produce a copy of the agreement, or admit to not having one.

    would someone be kind enough to point me in the right direction.

    Hi Diane, please ignore the letters from Mercers or any other DCA that BC see fit to sell your details too. I have been round the DCA houses myself with BC. BC have sent me all sort of letters but no agreement, and I have been requesting one since the middle of 2009!

    DON'T SPEAK TO DCA'S ON THE PHONE. If you feel inclined to write to them check out Curlyben's 'Bemused letter'.

    Threatening letters used to wind me up, especially postcards threatening home visits. However I soon learned thanks to LB that DCA's are all toothless and will try any tacktic to take money off you (they work on commission), just file DCA letters under 'ignore' and get on with your life. If you get a postcard don't worry they never come for a visit!

      Thanks Ruby that has put my mind at rest.
      Still keep getting phone calls everyday. I have written them the bemused letter will post tomorrow.
      I have also requested that they put everything in writing. Do you think they will ever stop phoning.
      They ring at all times of the day, even sundays, the last time i spoke to them they said they would be doing a doorstep collection.
      I just hang up on them now.

          I have now received a further letter from Barclaycard,

          "I write further to your recent communications concerning your barclarcard account. Your complaint has been forwarded to me in order that I may investigate and respond in my capacity as a customer relationship manager.
          I understand from your letter that you are unhappy with contact from Mercers debt collections ltd regarding your barclaycard account and you have stated that you have no knoweldge of this account.
          I have reviewed our records and they show that a direct debit was set up and held in your name. payments ceased from15th october 2009.
          I can also confirm that your previous request for information relating to the section 78 request has been sent to you on the 30th september 2009. Further letters relating to this matter have been sent on 27th nov 09 11th nov 09 and 2nd nov 09.
          Our response fulfils the obligation under the section 78 of the consumer credit act 1974, you should carry on paying the debt you have accrued on your account. we do not class your account as in dispute, you have been supplied with the relevant documation under section 78 of the consumer credit act 1974, and we will carry on with the collection services.
          If you send us further correspondence questioning compliance with these areas of law, we are not obliged to respond beyond the statutory response we have already given you. We would require you to provide evidence to support your claim as to ascertain whether responce is necessary.
          Your account has become overdue for payment, therefore in these circumstances Barclaycard needs to contact you to arrange recovery of the amounts owed.
          Barclaycard has the right to instruct a third party to act on their behalf in dealing with your account and Mercers will continue to contact you be telephone and letter until a suitable repayment agreement has been made.
          Whilst your comments are noted, we do not agree that Barclaycard or Mercers are in breach of any legislation or guidelines nor have we engaged in activity that can be considered to be harassment or criminal."

          I note nowhere in that letter do they mention the fact that they have been charging me ppi when I did not ask for it.
          The amount owing on this account would have been cleared way back in August 09 if they had complied with my request to repay the ppi.

          I am not sure where I stand on this now, could someone please help.

              I wrote them the missold ppi letter. This was before I even asked for the cca.

                    OK here are the letters for reclaiming PPI http://www.legalbeagles.info/forums/...ad.php?t=10646
                    the first you say you sent off, then you should have followed this up with the LBA letter, sticking to your timescales and not theirs.
                    This is with the intention of going the court route, you could go through the FOS takes a while, but the choice is yours.

                          Good luck Dizzy, been off the site for a while, my mother-in-law has discovered a lump in her breast so things have been fraught.

                          You have been receiving BC's standard response/cut and paste letters, please don't let it get to you and best of luck with the PPI claim. If it is not too late to add send the letters registered to that they can't claim they did not receive them.
