  • No CCA, what to do next?

Hello, new person here who needs advice. Sent off CCA request 21st August and have heard nothing. I'm about to cancel monthly payments made by debt management company but I'm wondering if there's a final letter I should send to JB Debt Recovery. Should I be letting them know that I believe the debt to be bogus or shall I just cancel the monthly payments and stay quiet. Feel that there is probably a final letter that I should be sending them but cant find a template that fits. Also, I've lost the receipt for the recorded postage, could this be a problem? Any advice would be much appreciated. Regards C.

"Although scalar fields are Lorentz scalars, they may transform nontrivially under other symmetries, such as flavour or isospin. For example, the pion is invariant under the restricted Lorentz group, but is an isospin triplet (meaning it transforms like a three component vector under the SU(2) isospin symmetry). Furthermore, it picks up a negative phase under parity inversion, so it transforms nontrivially under the full Lorentz group; such particles are called pseudoscalar rather than scalar. Most mesons are pseudoscalar particles." (finally explained to a captivated Celestine by Professor Brian Cox on Wednesday 27th June 2012 )

Once you have sent toe CCA request they have 12 working days to comply.
Once they fail you can lawful cease any and all payments, especially as this is a DCA.

There's nothing to be gained in reminding them of this fact unless they continue to issue meaningless threats.

As long as you KNOW they have cashed the prescribed fee you are all good

So, was the £1 cheque or postal order cashed?
Proof of postage would have been handy but if they actually cashed the payment that would be helpful....

Mind you, having dealt with JB Muppet recovery, they are planks of the thickest type

What would happen if a ccj had been placed on the debt as well or previously been to court for increase payment?

Re: No CCA, what to do next?

Hi, I am doing this with MBNA, I have payment arangement with them and they have finally stopped charges and interest. I have sent off for a CCA. If I stop payments and they do actually provide a valid CCA, even if it is late (after 12+2) then would they insist on interest and charge me for late payments etc? I could lose my payment arrangement?

                  Thanks in advance

I am keeping up with the payments to MBNA until it is obvious they don/t have the CCA. I can't risk losing frozen interest and payment plan.

I would have thought it would have already been deemed enforceable as it has gone through court and they have enforced judgement. :tinysmile_cry_t:

I have a question on this - if Lowell financial have entered a default notice on my credit file - if they cannot produce a CCA then the agreement is unforceable. So, if this is the case, how do I get them to remove the default date from my file. This data has been added by Lowell since last year even though they only started contacting me in January this year?!
