  • LINK Reconstituted Agreement - Unenforceable?

    Hi,

    Back in 2020 I made a CCA request to Link over an old debt.
    After a while they sent me a reconstituted agreement. On looking over it I didn't think it was correct, but kind of left it and continued receiving the odd letter etc but nothing more.

    Before Christmas 2025 this ramped up to much more frequent calls (never answered), emails (never responded to) and eventually being told that Resolvecall would be coming to my house (and actually a letter today from Resolvecall telling me to get in contact with Link to stop them visiting my property, which will be imminent if I do not).

    The debt is for £520.44, and I haven't made a payment since I think about March 2020 (I can check this) and had no contact with them from my side since the CCA request (I made a settlement offer but think this was before the CCA request and was declined anyway).

    I am wondering if this increased pressure is due to the fast approaching 6 year statute barred time?

    Also my main reason for posting, is how do I check their reconstituted agreement for validity/enforceability and what do I do if it's not enforceable.

    If I contact them to tell them it's not enforceable (should that be the case) then does that reset the clock for statute barring?
    I'm really torn but do not want people at my house

    Welcome to LB

    Resolvecall has no powers. They are just a 'nuisance', but can't do anything.
    The Statute Barred will be from the date the account was defaulted by the Creditor.
    You could send then a Statute Barred letter, but the debt might not be Statute
    Barred.
