  • Link sending round 'the boys'

Just received a letter from Link about a debt from an EGG card that subsequently got taken over by Barclays and bought by Link. In April 2023 I sent a CCA request to which they sent back details in May of the account number, what I had been paying them on my DMP at the time but nothing that constituted a CCA request but also nothing that said it was unenforceable. They have contacted me a few times by letter and email asking me to contact them so we can 'find a solution'. I haven't replied and had stopped paying when they sent back the fake cca agreement. The last 4 weeks they have sent me 2 letters and 2 emails with the final letter saying 'To reconnect with you, our representatives will visit you at home. We've been trying to reach you to discuss your account as we want to see if we can help you bring your account back up to date or agree with you a payment plan that supports your needs. If we do not hear from you or receive a payment within the next seven days, we will instruct our partners, Resolvecall Limited, to visit you at your home address.'

What would be the best way to sort this as I don't really want people coming to my house. Should I contact them and reiterate that they have yet to send me the correct CCA I requested in 2023?

    Many thanks

Quick update. (I may have been getting confused with another creditor)
I have found a letter from 3/7/23 saying the following...

We wish to apologise for our delay in supplying the requested documents in regards to your previous Section 77/78 request as part of the Consumer Credit Act 1974.

Unfortunately the original creditor has been unable to comply with your request and therefore the account is considered as unenforceable.

Although the account is currently unenforceable the outstanding balance remains collectible and it is acceptable for creditors to register and continue the reporting of a default.

This completes our obligations under section 78 of the Act.

As for Resolve Call, they have no powers whatsoever, the post person has more.

You could amend the following and send it to the Creditor.
Make sure you get Proof of Postage.
