  • CCA advice for non response

    Hi,

    i won’t go into personal details as we all have had sad stories. Anyway due to serious ill health I had to leave my job. I am recovered & now job hunting. However in the meantime I have struggled immensely to pay my bills & my 3 credit card debts were what I let slip.
    Anyway many years ago I was very active on a debt forum re CCA & so I decided to use my experience & make CCA requests to all 3 of the companies. I sent the letter requesting the details under CCA s77,78&79 with postal orders to pay the fee. Three letters were sent by registered mail & delivered (signed for) on 7/8/25.

    Since then I have had absolutely nothing from 1 of them; one sent me a regular monthly statement of account & 1 of them appears to have sold my debt on -I received a letter from new company stating that they owned the debt, or words to that effect- but no acknowledgement of my CCA request. Four weeks had passed by the time I received the letter -I know that there is a responsibility on the original credit card provider to pass the info on to the new company. So I’m just wondering as I am a bit rusty, what are the next steps? I know that they can’t do very much unless they are able to come up with the agreements. The debt that has been sold on I think will be the same. 33 days have passed since they all received the CCA requests. Should I do anything or just sit tight and wait on their responses, if they ever come? Thank you for reading this epic!

    You could send a 'follow - up' request. State that the debt is 'unenforceable' until they comply with your CCA request, if they can't comply, then they need to tell you that is the case. Or you could wait to see what they do next. Even if they send copies of CCA's they might not be 'compliant', so they need to be checked for 'anomalies'.

    They will also need to provide 'Default Notices' and Letters of Assignment to enforce the debts through the Courts, if it ever gets that far.

      Thank you ECHAT11, I was thinking that I would just wait it out & see if I have any further contact from them. I have never had any default letters. As said, since sending the cca requests none of them have contacted me at all re payments, bar getting a routine statement from one & the letter informing me that one of my debts had been bought by another company. Ta.

          Ta much. So glad this forum is still active, a few others seem to have disappeared,in fact one of them looks as though it has been taken over by a financial org that owns debts.
