    Hi there, I’m in a bit of a pickle. I bought a pre registered car on Monday (30th June). Drove it home, got home and it was making a very strange deep chug/rattling type sound. It’s a hybrid, I called up the dealership and said I’m not happy what can you do about it. Told me to bring it in yesterday, and they will look at it. I went back yesterday, not turning the engine off, as it seems to happen once the car has warmed up. The seller and a mechanic came out to look/listen to it. After over 3hrs at being at the dealership, they said have a curtesy car, we will get it looked at. I think it’s provisionally booked in next Monday (7th July)
    This has been extremely stressful, I don’t want the car now, I’m wondering where I stand. I paid some on credit card, part exchange and a debit card. I’m really upset and don’t know what to do. Any help or insight would be extremely appreciated.

    You can reject the car under the Consumer Rights Act 2015 as it's within 30 days of purchase.

    Send the dealer the following letter, send it Recorded Delivery.

    If you get no joy from the Dealer, make a Section 75 claim as you paid by credit card with your credit card provider, send
    them the following letter, make sure you get Proof of Postage.

      you have one difficulty in rejecting the car now.
      It appears that you may have agreed for the dealership to repair the vehicle.
      If that is so you cannot reject the vehicle unless they fail to repair it.

        Agree, see if you can deal with the 'provisional' repair first. It might be 'Monday 7th or a date to be 'determined'.

          Hi there,
          Thank you so much for your help.
          When I phoned up (the evening of picking up the car) the guy I spoke to said I can’t do anything.
          When I took the car back, I told them I don’t want a repair, I don’t want the car back.
          The guy who sold it said, they have to find a fault to give me a refund.
          I filmed the car making noise on my phone, when I got home with it.
          I then filmed it when I took it back to Arnold Clark.
          Am I within my rights to send the letter saying I’d like a refund?
          The day I picked up the car , I looked it over, I found chips on the bonnet (not the food). I told them I wasn’t signing the agreement. They kept saying you expect that on the car, I said it’s a month old and I don’t expect all those chips. The seller then came back with an agreement of re spraying the bonnet, not the buffing that he originally mentioned.
          I got that in writing (in an email) last night.
          Am I ok to go ahead with the letter saying I reject the car?

            a) Well, yes, you have been mislead'.

            'When I took the car back, I told them I don’t want a repair, I don’t want the car back.

            Make sure the above is included in your letter to Arnold Clark.

            Email it to the Branch today, but also send the dealer the following letter, send it Recorded Delivery,

            b) If you need to do a Section 75 claim.

            In the letter to your credit card provider, attach a separate summary sheet, that has dates, times and events.

            c) Option if you need it, email the CEO of Arnold Clark.

              this was their reply.

              However, the Act also allows the seller a reasonable opportunity to inspect the vehicle and verify the issue before any decision on a refund or remedy is made. This inspection process ensures that we fully understand the nature of the fault and can respond appropriately in line with our legal obligations.




              As such, our service team has taken the vehicle in to carry out a full assessment. Once this has been completed, we will be in touch to confirm our findings and discuss the next steps.                   Good evening, I just wanted to let you know, i sent the emails rejecting the car, I only contacted AC by email.
                  It took a few days. At first, the manager offered me to take the “new” car and £300, but I said no.
                  They finally agreed to giving me my money back.
                  I did not get the old car back, as they said they had refurbished it and it would cost more to buy it back from them.
                  Worked out better having the money in the bank, to get another car.
                  thank you for your help, it was really appreciated.
