  • CCA enforceable? Link Financial

    Hi,

Would greatly appricate any help with this.

I have been receiving letters from Link Financial for a couple of years, stating that I had a debt to Barclaycard. I have absolutely no recollection of this, there's nothing on my credit file with any of the 3 agencies. So had just been ignoring it as I assumed it was nonsense.

They then sent a letter saying they'd passed it on to someone and they would be visiting my house.

I therefore sent them the 'prove it' letter.

They have responded, after a couple of months.

It appears to be 2 separate agreements, with 2 different addresses. Neither have a credit limit on, or the date when they were taken out. I haven't lived at either of the addresses for probably over 7 years. Not sure why there's 2 agreements either?

There's also a photocopied letter from apparently someone at Barclaycard Customer Services saying the credit limit is £0, and the balance is £688.31. Which also is addressed to somewhere I haven't lived for over 7 years.......

Please could you let me know if any if this is enforceable? Is any of this legal?

Thank you in advance for any help!

    Hi Jon

    Welcome to LB

If a payment hasn't been made or the debt or hasn't been acknowledged in writing over the last 6 years, then the debt maybe statute barred,
    providing there is no CCJ.

If that is the case then send the following, make sure you get Proof of Postage.

    As to unenforceability - https://lawzone.legal/when-is-a-cred...0unenforceable.

    Update the thread.
