  • "Reconstituted" CCA

    Hi All,

    I requested a CCA from PRA last year for a debt they bought from Barclayard.

    For the past few months PRA have claimed that they have provided the CCA without having done so. They’ve provided statements a number of times for some reason, thinking…i don’t what.

    Earlier this week I received a file titled “Agreement or Reconstituted Agreement”, this is a CCA, however, it is not a true copy as it does not include my address at the time I signed up for the card. I have a couple of quetions I hope someone can help with…1) Would you explain to PRA why the CCA is still not valid (incorrect address), or just state that it is not and as such the debt is still not enforcable?, and 2) can a “Reconstituted Agreement” be considered a “true copy”, if it has the correct address?

    I would simply reply along the lines, use your own words.

    'Thank you for your recent correspondence, to date PRA Group has not fulfilled my request under the CCA 1974, it is against the FCA's Guidelines to state that a organisation has fulfilled the request when it hasn't. The FCA's Guidelines state that where this is the case the account / debt is unenforceable.'

    Depending on when the account was taken out, they can Reconstruct the agreement, but it must contain all the details at the time the agreement was taken out.
