My thinking is to write to the DCA asking them to confirm they have never issued a Default Notice regarding this account in the past. Also state I believe it is Statute-Barred and ask them for an SAR. Do you think that would be best?

a) Have you sent a subject access request (SAR)?

b) Once you get the SAR information, then decide what to do next.

One other question.. Are secured loans regulated by section 87(1) of the Consumer Credit Act? This is quoted in the latest Default Notice from the DCA. I thought secured loans were under a different section. If so presumably the threat to apply for possession could be inaccurate? Also should the original agreement cite the exact section of the Act and not just the words 'regulated by the Consumer Credit act 1974?'
