  • What info is needed to make a CCA agreement enforceable? PRA and barclays

    Please help if you can. We sent out CCA requests nearly a year ago.

    A few months ago PRA (who bought my partners Barclay card debt) sent us a big wodge of paper with lots of transactions going from 2014-2017 but with a cover letter saying they can't get all the relevant info and it's currently unenforcable.

    Today they've sent us a letter written 2 weeks ago from barclay card (with the wrong address on the letter head), saying it encloses a 'reconsituted copy of your credit agreement' and has written how much is currently owed.

    This said reconsituted credit agreement is photocopies of historic terms and conditions and no where does it say his name, amount, date, credit limits, anything. The actual only date I can find is a weird stamped date from over a year prior to the debt being taken out.

    Would really appreciate peoples advice on this.

      The whole point of allowing Reconstituted agreements is that they reflect the T & C's at the time the agreement was taken out and subsequently 'varied'. There are prescribed terms missing from the Reconstituted agreement i.e. credit limit, APR etc.

      So still 'unenforceable'.
