  • Incorrect Default from Debt Purchaser with no paperwork. Court Action?

    Hi, I recently checked my credit file and had a default from a company called perch capital for £200 in August last year. I did not recognise this at all so contacted the company and subsequently the DCA who is chasing it on their behalf. Turns out its an old loan from Sunny (recently gone in to administration). The only paperwork that this DCA are able to provide is a loan agreement from January 2015, no payments were ever made but Perch Capital have registered a default as August 2020 which is obviously incorrect. After numerous requests over the last few months, they are unable to provide any further documentation but are still not removing this from my credit file. I contacted the financial ombudsman but apparently Perch Capital are not governed by them and they cannot do anything.

    I have now missed out on a mortgage for my dream house and this has caused me some serious stress. Am I able to claim for compensation but more importantly apply to the court to make Perch Capital remove this incorrect default?
