  • Ombudsman for Online Retailers

    HI All

    Just a quick query. I have had a default for a little while now and am in a position to get letters out afte exhausting all other avenues with Very.co.uk or Littlewoods or Shopdirect whatever they are called ( it was through very.co.uk) I was just wondering what obudsman we use to complain to about this company. I believe I offered to pay back before a default was issued and was ignored and even attempted to pay online before a default wnd was rejected. I did try one earlier on https://www.theretailombudsman.org.uk however hillariously when I put in Very.co.uk it comes back and says they refused to work with the ombudsman so cannot procced. So they are already showing signs of being Pig ignorant. Anyway I successfully removed a default from Virgin Media through an ombudsman so want to try and use that service again. using the grounds;

    I consider that the main issues in this adjudication are:a. Whether the company has broken a term of the contract between it and the customer orfailed in its duty of care.b. Whether the reasons given by the customer are sufficient to justify the claim.

    Kindest Regards
    PTD

        Hi PTD

        If it were me I'd SAR SDFL* for all data.
        * https://ico.org.uk/ESDWebPages/Entry/Z7743227
        http://www.legalbeagles.info/forums/...ur-information
        On receipt I'd then put in an official complaint to SDFL
        https://beta.companieshouse.gov.uk/company/04660974
        They then have 8 weeks to investigate & reply.

          Re: Ombudsman for Online Retailers

          The good news is that the appropriate Ombudsman for this would be the Financial Ombudsman. If you had a consumer complaint about shoddy goods or misdescription you would need to go to one of the the retail ombudsman services, but this default relates to consumer credit so it's the FOS.

          You have only mentioned the default issue, but you may want to consider if you have also been given unaffordable credit. Catalogues are notorious for increasing people's credit limits to very high levels. They should do proper affordability checks so you may have an irresponsible lending complaint if this has happened to you. See http://debtcamel.co.uk/refunds-catalogue-credit-card/ for more info.

            Cheers all - Great help as always.

            I have already complained many many times to them directly as they had already sold my debt on they would not co operate, when i sent them proof of me emailing them to ask for a stop until my amount owed was disputed they had then defaulted.
            Annoyingly i did offer to pay them the whole amount regardless but their communications are next to nothing. For some reason they have also changfed the default date to reflect incorrectly but hey ho. Desperate for this one to go away as my first baby is on the way and could have a mortgage if this wasn't on im sure, we have a deposit but this default is dragging me right down!

                No! You need to file a complaint with the Financial Ombudsman: http://www.financial-ombudsman.org.u...complaints.htm. Easiest way is to do it online.
