    Hello I wounder if any one can help me please I sent for 2dresses with matching jackets from very one size 18 and one size20 the size 18 was to small for me I didn't even try the jacket on so I returned the size 18 the next day 16 days later very returned the dress and jacket back to me saying they can not except it back because it has been worn and is marked under the arms of the dress and jacket I do agree it is marked but I did not try the jacket on so there is no way it was me who wore it I have wrote 2 letters to them the 1 I know they have not revived yet I posted it 1st class recorded delivery on the 21st October and the other 1 on the 1st of November .i have had no. Reply off very about this matter can any one tell me what I can do about it please

    Your purchase would be covered by the Distance Selling REgulations. Have a look here and you'll see legally what they should do:

      As labman points out - You are entitled to return goods within 7 days starting from the day after the date in which you received them. This is not a return under warranty which VERY is trying to say it is by the looks of things. It is a cancellation of the contract in which you purchased said goods. Though as you also purchased the other dress at the same time and if they on one invoice, then you may actually struggle as the 7 day cancellation period effects the whole contract and all goods under it most be returned not just 1 of 2 goods ordered under the same contract.

      So unfortunately VERY may well be right here as what your doing by returning just one set of Goods under the contract is returning them under warranty, and they do not actually have to accept this unless there was a defect. Though if the marks were there when the goods arrived you would have claim for the dress to be replaced under warranty but not for a refund.
