    to answer your questions
    1.i suppose you could say i have had a major change in circumstances and they have deffinetly affected my finacial position. I met my partner who had 3 children i have moved into rented property we have a child of our own and another on the way and have just ran up credit card bills and a loan and this has all happened in the space of a year id say going from living at home to 5 kids is qwite major.

    2.i have nether written to hsbc telling them about my finacial position, i dont understand how that could help me speed up my claim to be heard though.

    wherer are these template letters on the site?

        There are some other personalised suggested letters on the travel girl( thread started by me ) and bluebells hardship threads.

        now apologies for being a bit vague but the definitions for customers who are in financial difficulty or hardship is defined by individual financial institutions as the banking code is only voluntary. Therefore there do not appear to be any "hard and fast " rules to guide you.

        I would say in general a change in circumstance caused by illness, divorce or redundancy or loss of a partner would mean you should at least be considered in a sympathetic manner . Even this does not mean the FOS would recommend repayment of the charges. Although in some cases they have. Although you have had change of cicumstance, it does not appear to be totally out of your control.,

        Having said this though I see no harm in identifying yourself as in financial difficulty and sending an income and expenditure sheet and explaining your position.

        It appears the OFT or FSA are in discussion with the banks on how to define hardship and it may even come down to the amount of charges you have accumulated in a year so at least you will be ahead of the game by identifying youself.

        the idea is to do a letter to the bank and then if no joy you go to the FOS.

          I refer to my claim for refund of charges on the above account. I am sure you are fully aware
          of the FSA’s Waiver hardship conditions. The FSA made the following statement in its Waiver announcement of 27 July 2007.

          "Consumers who are in very difficult financial circumstances - 'hardship cases'.
          Banks and building societies will have to conduct a filtering process to ensure that cases of genuine hardship are still dealt with during the waiver period. Cases of hardship would still be entitled to be referred to, and dealt with by, the FOS."


          You therefore have a clear obligation, both to identify severe hardship cases and to process them.


          I am therefore identifying myself to you as a customer who is suffering from severe financial problems and I hope you can assist me.

          here give a brief outline of your circumstances

          I enclose a copy of my current income and expenditure ( be honest they may check)

          The fact that you continue to levy charges and interest ? On my account is increasing the seriousness of my situation.

          I enclose a copy of my current spreadsheet and claim for charges and trust you may be able to offer me some assistance.

            hello people sorry i have not replyed sooner i have had to move house, well down size just to cut costs of living. Now i have mustered up the £75 for my case against monument and have had a letter from the court stating that there will be a hearing for my application of the removal of the stay. From what i can gather this is just for the removal of the stay not to settle the claim itself, so if i dont get any offers from monument before my court date any suggestions as to what i should take with me to support my application.

              Write to Monument and tell them you have a hearing to lift the stay and that you look forward to receiving their offer shortly.
