    I've just finished going through all of our old bank statements and I have found that Abbey have charged us the following on our accounts over the last 6 years:
    Account #1: £2,657 (£3,121.39 with interest)
    Account #2: £2,155 (£2,533.77 with interest)

    My flippin printer is out of ink, so I won't be able to send any letters till next week, but I intend to spend that time reading up as much as possible the best way to tackle them

    Any advice from those of you who are further down the process than me will be gratefully received :rolleyes:

    I am a little confused about account #2 as we are currently paying back an overdraft that currently stands at £1,137.59. Can I stop paying them as the account is now in dispute?

    Good on ya, good to see you getting started on this.

    As far as continuing payments is concerned, I strongly recommend you continue with any repayment agreements, the account being in dispute does not mean you do not owe them the money, continue with the payments then you can work out what you're going to do with the repayment when you get it.

      Regarding continuing payments all I can do is echo the comments above.

      Quick question, the figure you have shown including interest, is this interest on charges or section 69 8% interest? if the latter then this can only be claimed once you file the claim at court.

      For the prelim and LBA you can request the charges to be refunded plus any interest incurred on those charges (yes the maths is a headache and for simplicity many don't calculate this interest, myself included).

      I assume you will be running 2 claims so you will need to decide whether you are running them simutaniously or doing them one at a time.

      You could consider combining them and should you combine them once you file at court there will only be one fee for filing and one Allocation Questionaire, the combined totals will still be within the small claims track limit as the track is determined prior to interest being added.

        I used the calculator on moneysaving expert, so I'm not 100% sure which the interest is. I intend to initially claim a straight refund of the charges, and add the interest if it gets to court action.

        I am considering combining the claims, but I think I still have a lot of reading to do while I am waiting on the ink.

        These muppets gave us such a hard time, partly due to their charges, our debts snowballed to the point that we lost our home last October (10 days before giving birth). Now I want them to pay for all the stress they caused

          I just had a look at the MSE calculator and it is working out the Section 69 interest. So you are correct to apply this when you file.

          Reading is the best option at the moment and any questions either post them here or if you need an answer in a hurry you could try the chatroom.

              Well if you do, fire away, theres always somebody about to help or answer questions. Abbey settled mine today.............. 5.5K, so Im well happy. And even before a court date had been put out there too. Lol xxx

                    Finally got myself sorted (had some personal stuff to deal with )

                    I have now set the ball rolling with claim number 1, Abbey owe me £2155.00 (£2545.50 incl interest)!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!, now we wait for their response.......................................... .........

                          I have my, "we're sorry you felt the need to complain" letter (they'll be the ones who are sorry. They say it's going to take them 4 weeks blah blah blah. They will be getting another letter toward the end of next week.......

                            I have twice claimed off the Abbey. I love the " Sorry you felt the need to complain letter". They obviously don't read the preliminary letter. They don't seem to be able to tell the difference between the words "claim" & "complain". LOL
