  • Budgie Vs Halifax

I already have one claim for Halifax cardcash account stayed at my local Court since September 2007. Value £1400 charges plus approx £2500 compound interest. ( charges from 2004 to around 1 year ago )

Have just sent off LBA's for accounts 2 and 3 today.
Total being claimed for these two additional accounts is £2000 in charges plus £10500 in compound interest. ( Charges from 2001 to 2004 )

Will keep you advised and post up letters etc as claim progresses.

Glad to see your keeping busy ;-)

Are you planning on applying the same argument for CCI to your bank charges claims as you have to your credit card claim?

Hiya Stevo, Yep keeping busy. Also got mortgage charges claims to sort out with GMAC and the Associates and also missold PPI for both. Then need to start on the Ex wife's claims as well.

If by CCI you mean Contractural Compound Interest then NO. I don't like the Contractural word. When it gets to the Court stage I will be requesting that the Court consider awarding Compound interest to my charges claim calculated at the Halifax's APR. It's a restitionary claim of course to compensate for Halifax's unjust enrichment.

ah theres no catching you out today is there ;-)

Do you plan on filing at court quickly (assuming they dont reimburse you on receipt of the LBA lol) or are you planning on waiting on the outcome of your credit card claim?

sorry for quizzing you, i do have a genuine interest :okay:

Will wait and see how the Capital One claim goes over the next couple of weeks ( Have given Halifax 14 days anyway ). Also we will know the outcome of the first CMC ( 22nd May ) and also hope to have a chat with Tom Brennan at the Petey meet.

But basically YES I plan to file at Court quickly. Am already researching and working on the POC which will include some subtle tweaks to differentiate my claim and strengthen and enhance my claim for restitution.

Would be grateful for your input Stevo!

I notice you have claimed CI ( Compound Interest ) on some of your claims as well?

The claims where i succesfully reclaimed including 'CCI' were settled before court and were based on the old mutuality and reciprocity argument.

I am aware things have changed substantially, hence my interest.

I have 1 claim left to pursue, although as the charges have been accrued over the last year i dont think the interest would amount to a great deal.

But, never the less, i am interested and will keep an eye on your claim :okay:
