    Ok have just done an email to Lynsey (spelt it right this time!) stating that i have tried numerous times to settle this matter before court, reminding them that it is only 3 weeks from court.

    The total amount at the moment is £2834, so I have said that I would settle for £2800, but conditional on hearing from themselves or Nastywest today and having the money paid to me within 7 days. Failing that then I would allow the court case to continue and await judgement.

    I finished it nicely by asking her to confirm who in Cobbetts should I send my court bundle to.

      Ok this is getting a wee bit confusing, put a delivery report and read receipt on the email, and have just received and out of office reply from Lynsey, giving the name of the person dealing with her cases, so I forwarded the email on to that person.

      While it is sending to her, i get a read receipt for the original email.

      Now I am confuddled! someone must be reading Lynsey's emails!

        Thats not unusual.. You can set up permissions on Outlook (assuming that's what they're using) for other people to read your email. We always used to do it at my last company, so any problems etc didn't go unread for a week or two.

                        here we go.....

                        I am not sure if it is actually yourself that is dealing with the claim that I currently have against National Westminster Bank, but it is your name on the defence, hence it is you that I am turning to.

                        As you may be aware, a court date has been set to hear this claim, the date being 7th August. This date is now only 3 weeks away.

                        I have given your client every chance to refund me the charges and it was not until after I had actually filed at court that I received an offer from them. Obviously by that time I had paid out for the court fees and wanted them reimbursing.

                        I have tried numerous times to settle this matter, but to no avail.

                        I am sure that you feel the same as I, that this can be settled without having to resort to going to court, and I for one feel that it is a waste of court time, when all that is needed is dialogue between all parties concerned. With this in mind, I would like to make a request with regard to settling this matter.

                        As of today, my claim stands at £x (this includes s.69 interest), with £220 of court fees to add, making a total of £x.

                        I am willing to accept £x as full and final settlement in this matter, conditional on hearing back from yourselves or your client by end of business today, and payment to be made within 7 days of this date. Otherwise then there will be no alternative but to await the court date and allow the court to make judgement on this matter. If this is to be the case, then can you confirm to whom I send Cobbett’s copy of the court bundle to.

                        I look forward to hearing from you.

                        The lady mentioned on the out of office email has given me the name of who is dealing with this and said that that person will get back in touch with me. How flippin difficult is it to get a yay or nay from their client? They know there is only 3 weeks now, and I need to actually have the cash before I discontinue. Oh well, it all goes into the court bundle and will show that time after time I have tried

                          Cobbetts.....Grrrrrrrrrr

                          I am in a tizz now!

                          My court bundle was supposed to be back today and I havent been able to send it. I am overses, and my shipment of goods does not arrive until after my court date, so a bit of pants really!

                          I rang the court yesterday to explain why I had'nt returned it, and they were actually quite nice. I just have to email/fax the stuff to them is it does happen to arrive before the hearing date, if it doesent, they said it may just be case that the hearing date is postponed.

                          They have advised me to let Cobbetts know of my situation, but I am a bit unsure about letting them know myself. I think if they know that I am overseas and that I have'nt submitted my bundle yet, then they will use that to their advantage. Anyone else agree?

                          I really need this cash back, and can't afford for them to not pay up.

                          Suggestions anyone?

                          I have already sent a letter to them a couple of weeks ago asking them to settle out of court, but heard nothing back from them.

                          Should I be hassling them to pay up by now?

                          Oh well, I have waited this long, a little longer won'y hurt

                          Any advice would be fab........such a lovely bunch on here!

                            Just email them and tell them that you have had a problem with your court bundle, that you have spoken to the court and they have advised that you email/fax it and so you are going to email/fax it to cobbetts. You don't have to go into too much detail.

                            Hope this helps

                            As a side note, have heard sweet naff all from either Cobbetts or NW today, so it looks like we are on for court!

                                I'd send coblers another mail on monday hun, 2 a week from now on.... keep at em, and print them out to add to your bundle... can only be good in the the eye's of the judge, and ya never know it may give coblers more of a kick! seemed to do the trick for fendy anyway
                                if there's anything you want finding for your bundle, just let me know hun...I'll help out where ever i can !
