  • Delta v Natwest **SETTLED**

    Hi everyone

    Was pointed in this direction by a few Natwest claimants.

    Started my crusade in Feb with my prelim, follwed it up with the LBA, but couldn't afford to file at court, sent them a letter giving them extra time, and they decided to ignore that. So I stopped feeding the kids and raided the Child Benefit and filed at court.

    Week later got an offer for what I had claimed originally, but it was too late, had just cost me £120, so I told them I would take it as part payment and pursue the rest (unless they wanted to pay it), next I heard was the Acknowledgment and intention to defend from Cobbetts.

    So have filed the AQ, Cobbetts said on theirs that I hadn't provided the information needed (how many times do they need that spreadsheet!), have now had couet date, 7th August.

    Did phone Cobbetts the other day to try and negotiate with them, but they said that they have sent the paperwork back to Natwest and are awaiting their client's directions. So I phoned Customer Relations and the lady that I spoke to there said that seeing as I had rejected the offer, I had no choice but to go to court, and that CRU don't deal with it now, it's in the hands of the Litigation Dept. She also said that she had no contact details for Litigation and that if I wanted them I had to ask Cobbetts (?)

    So that's where I am. Earmarked what the money is going to be spent on (good stuff like mortgage & bank loan payments, new bed for child etc etc)

    Looks like you will have to sit tight on this one. Natwest paid my claim about 2-3 weeks after the AQs were filed and we had just got a court date.

    Fingers crossed they will get the cheque book out soon.

        Squaring up

        Ok, now I have about a gallon of coffee sloshing about inside me, I am starting to feel more awake, and so have decided to be proactive. I have just emailed Ms B at Cobbetts (the only contact name I have is the person that signed the defence), I have writen a loverly flowery email about not wanting to waste the court's time etc, and offered to settle for just over 2.7k (have knocked a few quid off), and asked her to put it to her clients, and that I would like to hear something within 7 days of the email.

        Put a delivery report on it and read receipt, del report failed for some reason, but I have just had the read receipt back.

        So now we wait.

        Oh for information..... according to all the blurb at the nottom of the email, Cobbetts have moved house to Mosley Street.

                        Oh well, it's now day 5 of 7 with regard to my email to Cobbetts, postie not due yet, not that I am expecting anything

                        I'm just so sick of the wating around, I mean it's not as if they would wait this long if it was the other way round, nope we would have been in court, ccj'd and probably evicted by now!

                            Wow, I just had a brain wave. All the banks should get together, employ a load of people, call it say 'The Penalty Charge Office', these people just deal with the bank charge claims.... one central place, and they should also employ the services of a courier company to take the strain off the post office. And hey presto, people get paid back quicker, bank workers can concentrate on selling us products we don't want , it takes a load of people off the unemployed list, and some lucky courier is raking it in!

                            Surely it would cost the banks less to do it this way, cos it wont cost them £220 per claim in court fees (initial filing and AQ), and it won't cost them the 8% interest.

                            There problem sorted!
