    Starting my Halifac bank charges refund.
    I have not received any response from Halifax re the above and haveno choice but to start my small calim
    Anyone with idea re completing Particulars of Claim, please

    Hi welcome to LB,
    You have tagged onto a thread over 5 years old I'll ask the team to start a new thread for you.

    Reclaiming bank charges became almost impossible a few years ago when the OFT lost a
    " test" case on this.

    Why do you think you should reclaim?

      Many thanks indeed for your help
      It is not proportionate to the overdraft I was being charges for; I wasnot told when the package account was sold to me that i could have a free banking account; i was given the impression that i am a valued customer and that my account change was unique; i do not recall being asked all the relevant information to find out if the account was suitable. I did not want to change as nothing was wrong with my old account.
      Not sure if i am responding via the right thread but need to complete my small claims by end of next week

          I think what you need to do is put the matters you have posted here into a " Formal Complaint" to the bank, charges for mis-sold packaged accounts are reclaimable, google a relevant senior manager/director of the bank and send the complaint to them.

          I'll help if needed.

                Not knowing the details of your situation, obviously. But thisa sounds like a reason to complain to the Financial Ombudsman, not start court action.

                It's free and someone will look at your case in the round, rather than through the lens of the consumer credit act and previous case decisions.

                  If it's on packaged account fees then have you worked out how much? Why was it missold? Who did you send the complaint to and did you receive any receipt of the letter?

                  How have you argued your case on the packaged account fees bit?

                    Indeed you are right but felt that as I have written to them and have given them more than plenty of chance to respons to my letters and they have ignored all of it that i have no choice but to go thrugh with it. I know they have received the lettrs as theybw ere all signed for.

                      that they gave me the impression that they were only asking a few customers to change to this brilliant new account facilities; i recall asking that i really donot wish to change as i was happy with my account and i was told how brilliant the new card was; an insurance policy that i do not need and made to go to another branch to sign for it for some odd reason.

                        apart from the charges, i have also worked out how much and I sent it to their head office via signed for 2ce and still have no response.
                        I have not fully argued the case re packaged account yet so need to sort my Particulars of Claim
                        What kind of info would you need and I will provide
                        So sorry I am so nervous

                          Particulars of Claim is the court side, I don't deal with that side of things so I cannot advise on a court claim. Not my preferred route to be honest and never advised that route in regards to specifically packaged account charges. The fact that they have not responded suggests that potentially it has not been given the priority that it needed to have been given.

                              First things first before setting up a Small Claims Court Order Make sure that your Particulars are in order. I made a mistake on this. As its with the Halifax you need to put amount of what it is for ie amount against Bank of Scotland for etc. Get some help off howlett clarke solicitors they are quite good. Get as much legal knowledge ie read banking laws Unfair charges regulations 1999. Etc there are loads of laws. Contact Halifax straight away ie write them a letter use Small Claims Courts as a last resort. contact the FOS Financial Ombudsman service.
