  • Peed 'orf v HSBC 1 - ** Settled **

    I had an account with HSBC for approx 15 years. I closed it in 2001 due to the charges were ridiculous.
    Being self employed, money owed didn't always arrive when promised, so HSBC hit me hard and often.
    The snowball affect is still with me today.

    I’ve sent off the SAR, and the LBA for the SAR. Also a non-compliance for the SAR. The only replies I’ve received are telling me they don’t keep the info past 6 years. etc etc etc……..
    I do have a letter sent to me in 1996, “ref: FICHE” with a copy of a statement from that time. Now… even though this is old, it does prove they have Microfiche (not that there’s any doubt).

    What is the most effective way to get the info, N1 or ICO?

    Charges alone should be £10k-£15k+ and that’s without interest.

    Hello, I am not surprized that your abit peed off at them. I have read somewhere that the ico is rather busy and can take up to 8weeks to get back to you. So its up to you N1 or ico. Someone may be along soon to advise further.

    They would try and get out of it for all that dosh

      You need to sue them under s.7 and s.15(2) of the Data Protection Act for non-compliance and if you wish, you may also file a complaint with the ICO, but as has been pointed out, they ICO are very busy right now.

      Do not give them any more time - they have had enough.

        Hi guys.
        As strange as it may seem, I have a claim in with HSBC that I forgot about! (when starting thread)
        Court date 2nd July 2007, 2 weeks today. Sent off Court Bundle last week, not received anything from HSBC!
        They do say "no news is good news"

          Hi peed

          We seem to be in the same boat. I have received a letter back from HSBC(see RLJ v HSBC Business Account). I have 2 claims with them and my N1 is due tommorow. I'm starting to gat a bit edgy now because i know i'm in for the long haul. I wish you luck.

            Hi guys.
            Had a letter from DG Solicitors yesterday saying as my claim is outside the 6 years, I don’t stand a chance of winning. And that I should get proper legal advice because when I lose I will have to pay their costs. So, if I sign the enclosed letter to the Court, cancelling my claim, they would forward it for me. Isn’t that nice of them?
            So a letter went back saying, I would invoke S.32 1 (b) (c) of the limitations Act. And informed them they had not mentioned the Statute Barred in their defence. And told them I’d written to the Court, asking for their defence to be struck out, as the hearing is ten days away and I have not received their Court Bundle as per the Judges directions.
            As for costs…it’s small claims Court!

            So, if you need a good Solicitor, don’t use DG. Lol.

              Did you make mention of the Limitation Act in your Particulars of Claim?

              Did you also just write to the court or did you make an application to strike out their defence?

                Hi Cetelco, no I didn't mention it in my POC. And I sent a letter informing the Court, that the defendant hadn't complied with the Judges orders served on them,for the Court Bundle. So "the Defendants non compliance has caused a significant inbalance, particularly as they are represented by Specialist Solicitors, and I am a litgant in person. so I ask the Court to consider making an order pursuant to rule 3.4 (2) (c) of the civil procedure rules".

                Is that a problem?

                  The thing is with D & G who act for HSBC they do not do bundles and have no intentions of doing so, but they will try and settle a week or so before your court date. So, if your court date is 2nd July I believe they will make contact with you this coming week.

                  They tried that trick on me with the limitations act as a couple of the charges were just outside the time, although there in time when I started. In my case they did not send in their bundles and the judge had ordered that they send in their evidence by a certain date which they breached and whilst they paid me in full, shortly after they paid me I received the order from the court striking out their defence and awarding me £50 costs.

                  Good Luck and keep us advised.

                          This morning I've received the offer from DG. Just £15 short of what it should be.
                          In the acceptence gumph it gives an agreement date to date, instead of for this claim! Me finks they've got my information, and they know I'm gonna whack 'em again!
                          Anyway....didn't like it, so I crossed it out! Also crossed out the confidencialality bit too! As well as the bit where they can inform the Court it has been settled! Stating I'll do it when they pay up.

                              Try 0121 455 2479, you'll get to speak to a proper person but they'll try to give you another number (which is the one you had) if you shout long and hard enough at them, you may just get some info.

                              We phoned the bank, they said the refund was approved on 1st June but is 'pending' on the account - they have until 4 O'clock this afternoon, then its referred backto the court for us.
