  • Robdblynd v Abbey (1) *** SETTLED ***

    Well as promised, a run down of where I am with this.

    Statements requested on 21st Jan 2007.
    Acknowledged on 30th Jan including promise of micrfiche printout.

    14 months statements arrived 30th Jan.

    Microfiche photocopies arrived 9th February.

    Prelim request for repayment sent 23rd Feb.
    Had heard stories about Abbey saying nothing arrived so sent it to MK and Bfd.
    Delivered on 26th Feb.

    Reply on 28th Feb.
    Standard "sorry you're unhappy and have complained, see you in 4 weeks" and complaints leaflet enclosed,

    LBA sent 13th March to MK.

    27th March, standard "taking longer than expected, see you in another 4 weeks" letter received.

    2nd April "charges fair etc but here's £815 as Gogw, now go away" letter received.

    2nd April Claim filed for total of £10,288.43 inc s69 interest and court fee.
    Deemed served 15th April

    7th April "thanks for gogw but want rest" letter sent and "claim filed, see you in court included".

    17th April "looking at 'complaint', be back soon" letter received.

    19th April Acknowledgement of service received.

    24th April Defence received from Abbey.

    25th April "sorry it's taking solong, wanna talk to ombudsman?" letter received.

    27th April AQ received. File before 14th May.

    2nd May, Filed AQ and paid £100.

    8th May emailed and faxed letter to Inga Kirkman offering to settle for amount outstanding and wouldn't apply for 'wasted costs order'.

    14th May Received AQ from Abbey.

    15th May Letter from court with reurn of AQ fee, AQ dispensed with.

    15th May Rang court, they confirmed AQ dispensed and Abbey request for stay of 1 month will not be granted, so got permission to write to judge and ask for abuse of process and standard disclosure be considered as he's not reading the AQs.


    17th May Inga Kirkman replied via email. Offered £6,100 in f&f and quoted Lloyds case at me.

    17th May, replied within 30 minutes of receiving email, basically said Lloyds case not relevant. Won't settle for less than last figure quoted and "Oh by the way, we're in Mercantile Court on 28/06/7, so see you there".

    So far, the silence is deafening but someone else I know didn't get a reply for 19 days.

    Bless them, they're snowed under.

    Just in case, I'm preparing my court bundle cos court office told me they're so far behind I might have very few days to get bundle into court so I want to be ready just in case.

    If Abbey don't reply in the next 24 hours I'm gonna withdraw the settlement offer and the cost goes up cos I've got about another £400 in court bundle preps.

    Oh well, onwards and upwards as they say.

    Just starting personal claim cos this one is joint account. Will start new thread for Abbey (2) so I can report progress.

    And that as they say, is that so far.

    Hi Tricia,

    See you have everything well in hand and dare I say it seem to be enjoying yourself. My how things have changed since you first dipped your toe in the water .

    Not sure if you will hear from the lovely Inga for a bit but I am sure that you will by about a week 10 days before the Merc hearing.

    Would offer to keep every appendage crossed for you but its not neccessary and would also be very uncomfortable.

    I'll look out for the thread on Abbey 2 (This time its personal) the sequel.

            So far no response from Abbey.

            Have got the Notice of Transfer to Mercantile and request for Case Management Information Sheet. Listed for Case Management Conference on 28th June in Leeds under HH JUdge Roger Kaye QC, who wants a test case so badly he can taste it.

            So now we wait, again.

                  Celestine, don't really need to do anything, but I'm going with draft orders, abuse of process and all the other bits and pieces, just in case. I've also prepared my bundle and think I'll take them along. Then if he sets a trial date they can have the lot straightaway. Might make the Abbey think a bit that I'm all ready to go.

                  Thanks BB, I've got about 3 different numbers for the legal team but I've contacted them once to offer settlement and they only offered about 60% so they can contact me now, I've tried my bit to keep it out of court. Let them explain why they haven't been in touch or responded to two letters and an email.

                  I hope you're right and that it is the closing stages but Im not holidng my breath, don't like the look of me with a blue/purple face

                      Hey BB, please don't stop breathing on my account. I'd hate to be responsible for you expiring while Abbey get their act together.

                      Just as a matter of interest, do you fancy having a look at the post I've put in CI forum? It's basically asking about the principle of applying for Restitution and see if anybody's got any ideas.

                      You being so expert and all, it might help if you cast your eye over it and see what you think.

                              Thanks Xena, I must admit the pulse rate was climbing a bit at the thought of High Court next week, even though my brain knew I'd done all the research and could argue my case if I had to.

                              Pulse nearly went through the roof when I opened the letter at lunchtime, it's over £10k they've offered so if we ever meet up it'll be a double g & t.
