    hi dudes!!!!

    just need some advice. a few years back i was in a lot of money problems. using this site, and a few others, i managed to resolve what i thought was all my debt. recently i have been contacted by lowells informing me they were chasing a student overdraft of £2000.00 that i had but they are trying to recover just under £2200.00.

    the thing is i am pretty sure i satisfied this debt a few years ago???

    i am going to send a sar off but im not to sure as to whether i should send it directly to the bank or to lowells???

    also what can i do to keep lowells off my back until my concerns have been resolved??? i dont want them to take me to court to get a quick resolution.

    Hi

    you could either send a SAR to Lowells along with a CCA request to see what they have on you
    or
    If you know what the debt is and where it came from then you could send a SAR to the original creditor
    or
    If they have made a clear threat of legal action you could send a CPR request

    Do you remember if you received a DN (Default Notice) for the debt at all from the original creditor??
    Is the debt correct as far as you can remember???

    What exactly has Lowells sent you?
    Is it a Formal Demand or a LBA or a Summons??


    The way Lowells have been issuing claims with the Bulk Centre like confetti lately, don't be surprised if you get a N1 Summons from Northampton Bulk Centre (If that's not what they have already sent you) from them

    If you do get (or have got) a summons then you need to acknowledge the claim on MCOL that you will defend in full as that then buys you time for you to see what your options are

      It's a long story, but basically I fell off the radar for a little while. So I have not received any documents apart from one informing me my debt is being passed from lowells to hamptons. But I haven't heard anything for a few weeks. Not had any formal demands as of yet.

      I did have a £2000 student overdraft which I defaulted on 5years ago, but I hadnt heard anything so hoped it had disappeared. Silly me :$.

        Is that Hamptons or Northampton Bulk Centre?????
        If it is the latter then that is a summons I suspect

          No it's hamptons. Just doing their usual passing you around to try and prevoke a response.

            Phew lol

            In that case if it were me I would just sit tight and keep an eye on what comes through the door

            If they send a summons then I would deal with that when it comes

            BUT that is just what I would do

            If you decide to send a SAR then you would be best to send it to the original creditor and not Lowells to see when you made the last payment and more importantly if they sent a DN

            With regards to Lowell getting a quick judgement against you, as long as you respond to any summons that comes through the door then they are not going to get a quick judgement

                Hi guys!!!

                Had a letter through my door from hamptons today offering a 50% discount for payment in full or £40 p/m until debt is paid. The original creditor is rbos, but I've never had an account with them???

                The letter says they 'may' not contact me again and they may issue legal proceedings.

                What's the best way for me to proceed????
