We have an on going claim with Barclays and had a court date through for sept last year. the claim has since been stayed and we need to try and lift the stay due to hardship but are unsure of which letter we should be sending to them?

Hardship is a difficult claim to lift. From my reading of Barclays, they seem to think hardship is sending a leaflet explaining how to run your account. It is much worse than that. The question is how difficult is your situation right now? How are the charges affecting your ability to live a normal life?

this is a very difficult time to be trying to lift a stay, with the test case due to start next week. The courts have been very intransigent regarding all claims, and they have effectively been denying justice to everyone by using the test case as an excuse not to do the job they are paid for.
Hardship means nothing really as the courts just don't seem to care. The latest position is that all district judges are frightened to make a credible decision and some have said that the only way they will acknowledge hardship is if the hardship is actually CAUSED by penalty charges, not jusy exacerbated by them. In most cases this means that it is impossible to get a stay lifted.
