    Hi, If a big financial company has breached Data Protection Act 1998 principle(s) for failing to comply with my request, can I seek compensation?

      Hi FP,

      Sure. I made a request for my information to a company (under DPA 1998) because I had a reason to believe that it withheld some key information which I needed. The company, although it submitted some information going back to over 10 yrs, they claimed it only retains data for a six year period. The decision by the Information Commissioner's Office is that the company has breached the sixth data protection principle, because the company has failed to disclose/does not hold any record of when exactly the data was destroyed.

        That their data retention records are lousy does not give you grounds for complaint.
